Also Present: Bob Flanagan, ZEO
Absent: Marshall Sanford
Mr. Ogonek was seated for Mr. Sanford who was absent. Ms. Atamian was seated for Mr. Shaban, who arrived after the meeting began.

PUBLIC HEARING – Application 10-01 – Johannes P. Van Brakel & Tricia L. Nelson, 9 Great Pond Lane – Special Permit and Site Plan Review

MOTION: ~Made by Mr. Ventricelli and seconded by Mr. Ogonek to open the public hearing. Carried unanimously.

Robert Flanagan, Zoning Enforcement Officer, asked that 17 documents received be entered into the record.
This application is the result of an enforcement action when a neighbor noticed a large number of dump trucks transporting fill onto the rear of the subject property, in close proximity to wetlands. The property owners and their contractor were not aware of permit requirements for this type of work.  A cease and desist order was issued March 11, 2010. The property owners responded and have been cooperative. An inland wetland permit has been secured and this has now become a remediation plan to remove the excess fill and restore the topsoil layer.
Mr. Toan Nguyen, Engineer for the property owners, spoke briefly as to the circumstances of the initial project and the details of the remediation plan. When the property was purchased, the owner wanted a flat rear yard and contracted to have fill brought in to level a sloped area. Approximately 1,000 yards of material was transported onto the property. The remediation plan involves removing 800 yards of material, which is estimated to take one week to complete. The material will be taken to a location outside of Redding. There was concern that the same contractor that initially did the work was being contracted to remove the material.
Mary Mullaney, 7 Great Pond Lane, expressed concern with the use of the same contractor, the steepness of the slope where the large trucks will be working, and asked if plantings were going to be installed on the slope. Any dead trees presenting a hazard will be removed.
Correspondence from the Planning Commission expressed marginal compliance with the Plan of Conservation and Development, and approved it as such. The Town of Ridgefield also expressed concern with erosion controls and impact to wetlands.


Mr. Flanagan recommended the following conditions.
1.  Allow the Zoning Enforcement officer to make adjustments and changes in the field to Erosion and Sedimentation Controls as needed.
2.  Call the Zoning Office 48 hours prior to work commencing, providing a timetable for the work associated with this application.
3.  Addition of Erosion Control Blankets in the area of the 1:2 slope.
4.  Receipts provided to the Zoning Office from applicant by the trucking companies involved in this permit showing where the removed fill material is being deposited.
5.  Daily Sweeping of Great Pond Road in the cul-de-sac area adjacent to 9 Great Pond Lane during the work activity.


MOTION: ~Made by Mr. Gordon, and seconded by Mr. Ventricelli to close the public hearing at 8:04 p.m.  Carried unanimously.
