PUBLIC HEARING
Michael Greenberg, 292 Post Road East, Westport – Discuss with Commission a Site Plan Approval for a 2 Story Office Building on 4 Old Mill Road, Georgetown.
Dan Conlon, Peter Romano and Michael Greenberg were present. Mr. Conlon stated briefly that this was an application for a site plan for a 7,000 square foot building, the proposed use of which is medical offices. The public hearing was continued from January 9, 2008 due to concerns of the town’s engineering consultants with regard to the ledge rock that will have to be removed on the site.
Mr. Romano presented a packet that responded to comments and questions from the engineering consultants.
The primary concern is the stability of the ledge on the south and eastern side of the property. Visible slabs of rock have slid down the ledge, and Mr. Taylor asked if there had been any geo-technical studies of the rock surface. Mr. Romano said that Doug Sims from DRS Blasting Consultants was not present but spoke on his behalf. Mr. Romano said based on visual analysis of the site that the plates that are sliding will be taken off. Vertical cuts of up to 80 feet will then be made into the ledge at such an angle that this sliding condition will no longer occur.
Mr. Casiello suggested that a condition of approval be that the rock ledge is evaluated by a licensed geo-technical engineer and that if stabilization needs to be done, that it is done by a licensed geo-technical engineer.
A response from the engineering consultant on the LandTech report is expected by next week.
Also discussed was the use of the parking area during nighttime hours. Mr. Greenberg said that he was meeting with Danbury Hospital on January 24 and would have more information about parking lot use of the tenant after this meeting. He expects that tenant use will be during daytime hours of office operation.
Mr. Conlon suggested that another condition of approval to consider be that the finished excavation be evaluated by a geo-technical engineer and if at that point any further remediation is required proper procedure can be followed.
Steve Burke from 25 Old Mill Road expressed concerns regarding the impact on his property from shifting plates and possible well contamination. He asked what contingency plans were in place and what options he had. Mr. Romano said that well monitoring is a common procedure for projects such as this, and that it can be added to the contract.
Susan Jackson, also from 25 Old Mill Road presented the following suggestions/concerns for protecting their property:
· Video tape the condition of her property prior to blasting;
· Have a seismologist on site at her property throughout the blasting project;
· View the credentials of the blasting consultant;
· Provide her with the name of the testing lab and have access to the pre-test evaluation;
· Test the well water pre- and post blasting.
Mr. Gordon asked for a copy of these suggestions/concerns for the Commission.
MOTION: ~Made by Mr. Sanford and seconded by Mr. Gordon, to continue the public hearing to February 13, 2008.
