The Commission went into Executive Session at 7:35 to discuss litigation with regard to the Riverbend Site Plan Denial. All Commission members were present except Joe Ventricelli; Michael Lavelle and Natalie Ketcham were also present. The Executive Session ended at 8:05 p.m. No motions were made and no votes were taken.
Mr. Gordon read the legal notice into the record.
PUBLIC HEARING
Michael Greenberg, 292 Post Road East, Westport – Discuss with Commission a Site Plan Approval for a 2 Story Office Building on 4 Old Mill Road, Georgetown.
MOTION: ~Mr. Casiello made a motion to enter the public hearing for the site plan submitted by Michael Greenberg for approval for a 2 Story Office Building on 4 Old Mill Road at 7:30 p.m. ~Mr. Sanford seconded the motion and it was carried unanimously.

Dan Conlan, project architect for the proposed new medical office building presented the site plan. He introduced Pete Roman from LandTech Inc., Doug Sims from DRS Blasting Consultants and Ed Killian from EarthMovers, Inc. Mr. Greenberg was also present. The original application was for a mixed use building and was withdrawn in June. Mr. Conlan explained that he had a letter of intent from Danbury Hospital to take the whole building for medical office use.
The site is on the south side of Old Mill Road at the corner of Route 57. Mr. Conlan provided photographs. The proposed building will sit in the center of the parking lot. This project received approval from the Water Pollution Control Commission in October 2007. The building will be served by a public water supply and sewer. The proposed building is two story brick.
The building will be surrounded on 3 sides by a parking lot of 61 spaces. In order to make room for the parking lot, rock will have to be removed from the hillside to the south of the 1.3 acre property. As much rock material as can be removed by mechanical means will be done before any blasting occurs. Building height, coverage, impervious surface area and required setbacks all meet current regulations. The property will be landscaped and drainage issues will be properly addressed.
Mr. Romano explained that he expects 60% or 7200 cubic yards of existing rock material to be removed. He anticipates 60-90 days of earth moving work, with 6-7 trucks removing material daily. The material will be taken to Ed Killian’s site in Danbury.
In response to a question from Mr. Casiello with regard to testing the stability of the hillside before removing rock, Mr. Romano said that right now there is no more than a visual observation. Mr. Sims will direct on site safety and said that while blasting will be minimized, it is unknown what the rock will do until work begins.
There is the possibility that the parking spaces will be available to the public after hours should the project be approved.
Neighbors Steve Burke and Susan Jackson expressed concerns with the effect of blasting on their property and lighting issues. Ms. Jackson asked that consideration be given toward dimming or shading the lights so there is minimal impact during night time hours when the building is not in use. Mr. Burke was assured that all state and local regulations will be met with respect to vibrations from the blasting. Every effort will be made to keep lighting to a minimum.
Ralph Bosch and John Morin expressed support for the building.
Mr. Taylor said there were several items of correspondence with regard to the project.
The volume of material had not yet been carefully reviewed~by Commission members. Mr. Casiello made the motion to continue the public hearing to the next meeting and Mr. Sanford seconded. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
