Zoning Public Hearing Minutes 12/12/2007
Present:   Frank Taylor; Chairman, Gerry Casiello; Vice Chairman, Ben Gordon; Secretary, John Shaban, Joe Ventricelli, Amy Atamian, Gary Miyishiro

Absent:  Marshall Sanford

Also Present:  Bob Flanagan, ZEO

PUBLIC HEARING
1.      Marilyn Sloper, Sloper Properties, LLC, 2 Main Street, Georgetown
Mr. Gordon read the legal notice into the record.

MOTION:  Mr. Casiello made a motion to enter the public hearing for the application submitted by Marilyn Sloper for an amendment to the Zoning Regulations, Section 5.9.3, at 7:30 p.m.  Mr. Gordon seconded the motion and it was carried unanimously.

Currently the regulations allow one sign and the amendment would permit signs which will be limited based on area.  The definition of a sign is also changed.

The changing of the regulations came about when the Zoning Enforcement Officer had issued a letter indicating that a business was in violation of the regulations.  It was pointed out that several businesses were also in violation and this amendment is an attempt to solve the problem.

Adam Labarski was present and explained that he was asked by Marilyn Sloper to help.  He indicated that most businesses have more than one sign.  If the regulations are not changed, Cease and Desists will need to be issued as there would be many not in conformance.

Mr. Labarski had also provided discs with photos on them to the Commission of various businesses.

Jo-An Brooks was present and questioned why the Commission did not just allow the same rights on each façade instead of changing the regulations.

Mr. Casiello stated that this proposal is a new definition in which the length of the business is considered and not the length of the building.

John Shaban feels that the definition may need additional work.

Raymond D’Angelo from the Preservation Society is concerned for the size and number of signs and asks that the Commission limit the number and allow for smaller and fewer signs to remain in the keeping with Georgetown.

Sherry Karraker stated that the size of the sign needs to be limited.  When Mr. Casiello explained that there is such a clause, she withdrew her comment.

Mr. Casiello sated that there are signs which have been there for a while and they have not been objectionable.

Frank Taylor informed the Commission and the public that they received a negative referral from Planning Commission.

Ralph Bosch sated that any building in which the façade is visible from the public way should be able to put a sign in order to let people know the business is there.  However, the maximum size needs to be regulated.

MOTION:  To close the public hearing from Marilyn Sloper.  Made by Gordon, seconded by Shaban.  Unanimous Approval.

                                                        Filed Subject to Approval

                                                        Respectfully Submitted
