PUBLIC HEARINGS
1. Mark Lake, 291 Blackrock Turnpike-revision to the zoning regulations on residential lighting
Mr. Gordon read the legal notice into the record.
MOTION: Mr. Sanford made a motion to open the public hearing for Mark Lake, 291 Blackrock Turnpike for a revision to the Zoning Regulations regarding residential lighting. Mr. Gordon seconded the motion and it was carried unanimously.
Mr. Mark Lake was present for the application and explained that his proposal is to revise the wording in Section 53.6(f) of the Zoning Regulations regarding the setback requirements on lighting. According to Mr. Lake, there is a fifteen foot setback requirement for some lights, but not others. He feels that his proposal would clear up the confusion. He submitted a copy of an article from the “New Yorker” written by the Washington Zoning Commission Chairman regarding light pollution.
Amy Atamian entered the meeting at 7:42 p.m.
Mr. Lake had submitted a letter to the Commission requesting that Mr. Taylor recuse himself from this application as Mr. Taylor had testified at the Zoning Board of Appeals hearing with respect to his situation. Mr. Lake indicated that he feels this was a violation of the State Statute. Mr. Taylor explained that he was present at the Zoning Board of Appeals hearing because it was an enforcement issue.
Additional correspondence included a letter from neighboring property owners, the Planning Commission recommending approval, and HBC regarding municipal impact.
Creston Ely of 279 Blackrock Turnpike was present and submitted a letter to the Commission explaining that his home was built in the 1800’s and one of the buildings is three feet from the property line. He installed the lighting at the recommendation from his attorney. He continued to explain that the Police

were called regarding his lighting, their report is enclosed, as well as Tom Gormley, his report is also
attached. He found his lights had been vandalized when he returned home from a trip. Mr. Ely explained that he has removed half of the original fixtures and all the watts are 20 watts. He asked that the Commission deny the application as if this were passed; it would negatively impact many people. Additionally, there is a six foot solid fence between the light and the building and Mr. Lake’s house is 150 feet away with bamboo, trees and a fence in between. None of the lights face Mr. Lake’s house.
Mr. Taylor recommended that a proposal of this nature would be better if it were describing landscape lighting as opposed to freestanding lighting.
MOTION: Mr. Gordon made a motion to close the public hearing for Mark Lake, 291 Blackrock Turnpike for a revision to the Zoning Regulations regarding residential lighting. Mr. Sanford seconded the motion and it was carried unanimously.
