Zoning Commission Minutes 07/11/2007
Present:        Gerry Casiello; Vice Chairman, Marshall Sanford, Joe Ventricelli, Gary Miyashiro, Amy Atamian and John Shaban

Absent: Frank Taylor; Chairman, and Ben Gordon

Also Present:   Tom Gormley, ZEO

CALL TO ORDER
Acting Chairman Gerry Casiello called the regular meeting of the Redding Zoning Commission to order at 9:30 p.m. and seated Amy Atamian for Frank Taylor and Gary Miyashiro for Ben Gordon.

CONSIDERATION OF THE MINUTES OF JUNE 27, 2007
MOTION:  Mr. Sanford made a motion to accept the minutes of the Public Hearing of June 27, 2007 as submitted.  Mr. Ventricelli seconded the motion and it was carried unanimously.

MOTION:  Mr. Sanford made a motion to accept the minutes of the Regular meeting of June 27, 2007 as submitted.  Mr. Ventricelli seconded the motion and it was carried unanimously.

REEDA B. HARSCHE, THREE LEVELS CORPORATION, 626 REDDING ROAD
Further discussion was tabled.

Mark Lake, 291 Blackrock Turnpike
MOTION:  Mr. Sanford made a motion to accept the application submitted by Mark Lake, 291 Blackrock Turnpike and to schedule a public hearing for September 12, 2007.  Mr. Miyashiro seconded the motion and it was carried unanimously.  

Redding Historical Society, 107 Lonetown Road
MOTION:  Mr. Sanford made a motion to approve the application submitted by the Redding Historical Society, 107 Lonetown Road for a Limited Duration Permit for an Antique Car Show to be held September 8, 2007 and to waive all fees except the publication fees.  Mr. Miyarshiro seconded the motion and it was carried unanimously.

Ridgefield Motor Inn, 296 Ethan Allen Highway
Tom Gormley, ZEO, explained that the original approval by this Commission including a storage and vending area.  The Zoning Certificate Inspection shows more than that.  Photos were provided.

The architect and the owner were present.  They explained that there are no additional rooms to the Inn, but that the second floor will be used as a motel unit.  They have not expanded the building.  

Any approval is subject to the review and approval by the Health Department and that there are the same number of rooms and parking spaces.

MOTION:  Mr. Miyarshiro made a motion that the modification to the site plan for the Ridgefield Motor Inn, 296 Ethan Allen Highway is a minor modification and no public hearing is required.  Mr. Sanford seconded the motion and it was carried unanimously.

MOTION:  Mr. Miyarshiro made a motion to accept the swap in which the proposed new laundry room will become the new motel room and the old motel room will become the new laundry room and this will be based on verification by the Zoning Enforcement Officer to determine that there are no more hotel rooms at the Ridgefield Motor Inn, 296 Ethan Allen Highway.  Mr. Sanford seconded the motion and it was carried unanimously.

John Read Middle School
The proposal is to add a sign.  There was a sandwich board sign which kept getting stolen.  This new sign will be to announce events.  

Mr. Gormley reviewed and indicated that the Board of Selectmen has granted their approval.

MOTION:  Ms. Atamian made a motion to approve the application submitted by John Read Middle School for a new sign.  Mr. Miyashiro seconded the motion and it was carried unanimously.

Candace Benyei, 29 Giles Hill Road
Discussion was tabled.

MOTION:  Mr. Sanford made a motion to add 60 Redding Road discussion to the agenda.  Mr. Ventricelli seconded the motion and it was carried unanimously.  

Mr. Taylor was concerned about the excavator and the trees being taken down at the back of the site.  An immediate stop order was issued.  Photos taken by Dennis Tobin were submitted to the Commission.  

Attorney David Bennett was present for the discussion and questioned what section of the regulations his client is in violation of.  The Commission explained that there is no approval for site work and there was an excavator on the site.  Section 3.8 of the regulations states that a permit is needed to do work and Section 3.8 pertains to construction equipment.  

Attorney Bennett feels that there was no excavation and if there were it would be within 100 yards.  Trees were taken down, rocks were removed and the area was flattened.  He also indicated that excavation is an undefined term.

Mr. Casiello asked that Mr. Gormley visit the site and determine if they cut into the hillside and how much was done.  The owner indicated that he would just like to finish putting some wood chips down.  Mr. Casiello indicated that he may stabilize what was done.  

MOTION:  Mr. Sanford made a motion to add the discussion of the State of Connecticut sign at New Pond Farm to the agenda.  Mr. Ventricelli seconded the motion and it was carried unanimously.  

Gerry Casiello recused himself from this discussion.  John Shaban was seated in his place.  

An additional sign was put up as an award by the Federal Government.  There are complaints being filed about this sign.  The Commission recommended that they come before the Commission and inform the Commission about their plans regarding this sign.  

Mr. Gormley also presented the Commission with an event to take place at New Pond Farm in which there will be an additional 10-12 cars per day.  It is no a public event and is only for four days.  

MOTION:  Mr. Miyashiro made a motion to adjourn the meeting at 10:25 p.m.  Mr. Ventricelli seconded the motion and it was carried unanimously.
