Zoning Public Hearing Minutes 06/27/2007
Present:        Frank Taylor; Chairman, Gerry Casiello; Vice Chairman, Marshall Sanford, Joe Ventricelli, Gary Miyashiro, Amy Atamian and Ben Gordon

PUBLIC HEARING
REEDA B. HARSCHE, THREE LEVELS CORP., 626 REDDING ROAD

Mr. Gordon read the legal notice into the record.

MOTION:  Mr. Casiello made a motion to reconvene the public hearing for the application submitted by Reeda B. Harsche Three Levels Corp. 626 Redding Road for a site plan to change the zone from R-2 to RV on a 14 acre parcel at 626 Redding Road and Gallows Hill Road at 7:30 p.m.  Mr. Sanford seconded the motion and it was carried unanimously.

At the previous public hearing there were two submissions, one from the Conservation Commission and the other from the Planning Commission.  Mr. Taylor explained that these referrals were advisory and that they can continue to submit these reports to this Commission as long as the public hearing is open.  A copy of these reports were given to Attorney Marcus.  

Mr. Taylor explained that the tapes submitted from a Conservation Commission meeting were regarding a different application and they will be removed from our record and will not be taken into consideration for this application.  

Mr. Marcus addressed the questions submitted by Milone and MacBroom.  He explained that recharge area 3 is approximately 150 feet from the pond and they will not be encroaching into the 150 foot setback.  He also explained that the development will be like the neighborhoods in Redding.  Mr. Taylor reminded Mr. Marcus that the plans show no lights at the ends of the driveways, therefore they will no be permitted.  Mr. Taylor also stated that the cross section is required for the retaining walls.  Mr. Marcus stated that the wall will be five feet high or less.  

Gerry Casiello stated that he does not feel the intent of the affordability plan is accurately stated.  Mr. Marcus indicated that the units do not need to be purchased by those who meet the affordable Zoning

requirement, but is must be leased to someone who does meet the requirement; however it is not clearly outlined in the documentation.  Mr. Marcus stated that he would make the adjustments.

Wayne Jacobson, P.E. stated that he has not seen the latest report from Milone and MacBroom.  

The truck radius has not yet been provided to the Commission.  Mr. Marcus stated that a template will be provided of the size automobile that can enter off of Gallows Hill Road.  He is certain that it will meet the radius requirements.  

Mr. Jacobson stated that the septic systems have been designed as individual systems per the requirements of the public health code and no additional testing has been done as it is not required.  Mr. Ventricelli questioned if he felt that additional testing should be done as this is in the Saugatuck River Water shed.  Mr. Jacobson stated that the offset distance is 50 feet away and they are 100 feet away from the water course.  He feels that they exceed the requirements of the Health code.
 
Ed Sharek of Kimberly Drive was present and submitted a letter by his neighbor to the Commission.

John Bonsignore of 636 Redding Road stated that he has listened to the tapes from the Conservation Commission and the driveway was relocated due to flooding.  He also stated that in the 80’s Gallows Hill Road flooded and then it snowed, which blocked access.  There is a risk of safety.  He also questioned how the electricity would be coming in to the development.  Mr. Taylor stated that the utilities are not part of the Zoning Commission regulations.  

Mr. Marcus responded that when is snows and floods people will just stay home.  

Mike D’Agostino of Glen Hill Road stated that the Commission should allow everyone who wishes to speak, the opportunity to do so.  

MOTION:  Mr. Casiello made a motion to continue the public hearing for the application submitted by Reeda B. Harsche Three Levels Corp. 626 Redding Road for a site plan to change the zone from R-2 to RV on a 14 acre parcel at 626 Redding Road and Gallows Hill Road until their next regularly scheduled meeting of July 11, 2007.  Mr. Sanford seconded the motion and it was carried unanimously.
