Zoning Commission Minutes 11/08/2006
Present:        Frank Taylor; Chairman, Gerry Casiello; Vice Chairman, Ben Gordon, Amy Atamian, Gary Miyashiro, and Joe Ventricelli

Absent: John Shaban, and Marshall Sanford

Also Present:   Tom Gormley, ZEO and Dennis Tobin, Assistant ZEO

REGULAR MEETING
Mr. Taylor called the regular meeting of the Redding Zoning Commission to order at
7:30 p.m. and seated Amy Atamian and Gary Miyashiro for absent members Joe
Ventricelli and Marshall Sanford.

CONSIDERATION OF THE MINUTES OF 10-25-06
MOTION:  Mr. Gordon made a motion to approve the minutes of the regular meeting of
October 25, 2006 as submitted.  Mr. Casiello seconded the motion and it was carried
unanimously.

132 Redding Road, LLC, Adam Lubarsky
Mr. Lubarsky was not present for this discussion; however a representative was present
and stated that he was questioning why a public hearing was not required on the
application presented to the Commission on the meeting of October 25, 2006 for a
restaurant/bar to be located on 2 Main Street.  Mr. Taylor explained that a hearing was
not required as it is a permitted use in the zone.  

Georgetown Village Restoration, Inc.
MOTION:  Mr. Gordon made a motion to approve the application by Georgetown
Village Restoration, Inc. for a limited duration permit for the 5th annual Georgetown Day
on Main Street, Georgetown, to be held on June 10, 2006.  Mr. Casiello seconded the
motion and it was carried unanimously.

Elio Cavicchia Sixty Redding, LLC, 60 Redding Road
Larry Edwards was present for the application.

MOTION:  Mr. Casiello made a motion to accept the application submitted by Elio
Cavicchia for a Site plan approval for a commercial building at 60 Redding Road and
schedule a public hearing for December 13, 2006.  Mr. Gordon seconded the motion and

it was carried unanimously.

Candace Benyei, 29 Giles Hill Road
Ms. Benyei was present as well as her Attorney and Engineer, Mike Willis.  Mr. Willis
distributed plans to the Commission as well as a drainage summary.  He explained that he
surveyed and analyzed what was there.  Recommendations from DEP for the concrete
fencing for the compost area are also included on the plans.  

The curtain drain does not extend into the driveway and they are not proposing to extend
it into the driveway.  

Frank Taylor would like for Nicole Burnham of Milone and MacBroom to review these
plans.  

Attorney Robert Fuller stated that this is not an application.  Ms. Benyei had come before
the Commission to remedy some issues which resulted in a cease and desist.  They are
clarifying what is on the property and some additional minor matters.  He further stated
that this has expanded from the limited purpose.  He did also state that the concrete slab
and the processing area are part of the plan.  The septic system, building and runoff are
not part of the plan.  

John Richardson and Laurie Richardson, neighbors, were present and showed a photo to
the Commission showing the overflow going Northwest on the property line.  They stated
that the berm which was referred to does not exist and the water runs along their property
line.  Mr. Richardson feels that the drainage system is inadequate.  

Mr. Richardson also questioned the driveway drawings.  The Commission explained that
there was a separate driveway permit issued in July for the driveway.  The drawings were
presented to Mr. Richardson.

Mr. Gordon recommended that the information presented by Mr. and Mrs. Richardson
also be submitted to Ms. Burnham for review.  Attorney Fuller requested that all
information sent to Ms. Burnham also be sent to Ms. Benyei’s engineer.  

Tom Gormley stated that there are still outstanding fees owed to the Town by Ms.
Benyei.  Attorney Fuller stated that this is not an application and feels that Ms. Benyei is
under no obligation to cover fees.  However, she has agreed to make payment.  The fees
for Attorney Lavelle have been addressed.  

COMMUNICATIONS
Ralph Bosch, business property owner in Georgetown, was present concerning the lack of
public hearing for 2 Main Street, Georgetown.  Frank Taylor explained that a public
hearing was not required as it is a permitted use in the zone and there was not a
substantial change.

A member of the audience stated that this business is quite different from what previously
existed and feels that this is a significant change as the hours will be extended and it will
generate noise and therefore should require a public hearing.  

Mr. Bosch stated that there appears to be some inconsistencies between this
establishment and Lombardi’s.  He questioned if it is possible to appeal the decision.  Mr.
Casiello explained that the appeal would be to the courts.  

Mr. Gormley delivered Mr. Taylor a communication which came addressed to him.

ADJOURNMENT
MOTION:  Mr. Gordon made a motion to adjourn the meeting at 8:58 p.m. Mr. Casiello
seconded the motion and it was carried unanimously.
