ZONING BOARD OF APPEALS
MEETING MINUTES
October 19, 2010—8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:00 p.m.
Paul Scholl was seated for Colleen Litof, who was not present.

REGULAR APPLICATIONS:

1010-1: 316 Black Rock Turnpike, Sam Callaway, Calloway Wyeth Architects, Agent, James S.J. Berray, Owner -Request variance for Sec. 3.11(a), to extend roof overhang an additional two (2) feet into existing setback.

Sam Callaway, Callaway Wyeth Architects, presented the application to the Board. Mr. Callaway stated that this extension to the roof overhang would not be visible from the road. The only neighbors who the addition impact visually wrote a letter in support, which was submitted as part of the record. Mr. Callaway explained that the point of the overhang was eco-friendly “green” construction, which would utilize the overhang to maximize sunlight exposure in cooler months and minimize it in warmer months. Mr. Callaway also said there was a difficult grade and slope to the property, making it difficult to consider any other option. There was discussion as to the necessity for inclusion of this type of “green” construction in considerations for future, similar projects.

Deliberative Session

The Board voted unanimously to enter Deliberative Session at 8:21 p.m.
During deliberative session, Board members determined that the house pre-existed zoning regulations and the overhang would not increase the non-conforming footprint of the structure. The intent of the overhang is to increase energy efficiency and that denial of the requested variance would create an undue hardship.

The Board voted unanimously to exit Deliberative Session at 8:25 p.m.

1010-1: 316 Black Rock Turnpike
On motion of Mr. Morton and second of Ms. Williams, the Board voted unanimously to approve the requested variance.

The Board voted unanimously to adjourn at 8:25 p.m.
