ZONING BOARD OF APPEALS
TELECONFERENCE TRANSCRIPT
JULY 29, 2010—7:00 P.M.

0710-01, 194 Black Rock Turnpike-- Dian Jennings Mayo, Owner and Applicant -Request variance for Sec. 4.6.5, to reduce side yard setback from required 40 feet to 21.1 feet for an 18.9 foot variance.
Board members discussed the above application from the July 20, 2010 Regular meeting of the ZBA. After discussing the matter with Town Attorney Mick Lavelle and Zoning Enforcement Officer Robert Flanagan, it was determined that it was the property owner’s responsibility for placement of the structure, not Connecticut Light and Power.
Deliberative Session
The Board entered Deliberative Session at 7:12 p.m.
On motion of Mr. Polio and second of Mr. Morton, the Board voted unanimously to grant the variance, limited strictly to the shed structure as currently configured, due to a demonstrated hardship based on the safety concerns related to the placement of the electrical boxes and non-transformer utility devices and the necessity for those boxes and devices to be protected from natural and weather-related hazards. The Chair will communicate with the Zoning Enforcement officer to ask him to consult with the relevant municipal departments, including Building and Zoning, to ensure that Connecticut Light and Power informs Redding property owners, prior to commencement any work on a particular property, that compliance with the Town Zoning Regulations regarding the placement of electrical boxes and other utility devices is
ultimately the responsibility of the property owner and not CL&P.
