ZONING BOARD OF APPEALS
MEETING MINUTES
JULY 20, 2010—8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 7:58 p.m.
No alternates were seated.


REGULAR APPLICATIONS:

0710-01, 194 Black Rock Turnpike-- Dian Jennings Mayo, Owner and Applicant -Request variance for Sec. 4.6.5, to reduce side yard setback from required 40 feet to 21.1 feet for an 18.9 foot variance.

Dian Jennings Mayo presented the application and answered questions from the Board. The house needed renovations and updating which required additional amperage.  Connecticut Light and Power (CL&P) installed a concrete pad with utility boxes that contained equipment for underground lines. After installation, CL&P recommended to the homeowner that a wall be constructed around the equipment to protect it from mud and falling trees.  A wooden cover was constructed by the homeowner and was found to be in violation of setback regulations by the Zoning Enforcement Officer.

Gardner and Ann Herbert, Meeker Hill Road, asked for clarification as to the details of the application, and were satisfied to know that this does not impact them in anyway.

Deliberative Session

The Board voted unanimously to enter Deliberative Session at 8:12 p.m.
During deliberative session, Board members discussed the issue of safety in protecting the equipment installed by CL&P. It was suggested to advise CL&P as to the possibility of violation of town zoning regulations when installing their equipment. It was determined that the advice of Town Counsel was necessary with regard to this issue.

The Board voted unanimously to exit Deliberative Session at 8:25 p.m.

0710-01, 194 Black Rock Turnpike On motion of Mr. Morton and second of Mr. Polio, the Board voted unanimously to table decision on this item pending Town Attorney opinion as to the responsibility of CL&P to adhere to town regulations in the matter of citing one of their structures that potentially breach Town zoning regulations.


The Board voted unanimously to adjourn at 8:25 p.m.
