ZONING BOARD OF APPEALS
MEETING MINUTES
MARCH 16, 2010—8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:00 p.m.
Bruce Given was seated for Henry Polio, who was not present.
The Board accepted nominations for Chairman and Secretary.
On motion of Mr. Morton and second of Mr. Given, the Board voted unanimously to appoint Michael Thompson as Chairman of the Redding Zoning Board of Appeals.
On motion of Ms. Litof and second of Mr. Morton, the Board voted unanimously to appoint Beth Williams as Secretary of the Redding Zoning Board of Appeals.
The Discussion of a Revised Fee Schedule was tabled for a future meeting.
REGULAR APPLICATIONS:
0310-1: 118 Mountain Road, Leo and Karen Weaver, Owners and Applicants -Request variance for Sec. 4.6.5, reduce front yard setback from 50 feet to 43.8 feet for an addition.
Attorney Catherine Cuggino, Chipman Mazzucco, presented the application to the Board and answered questions. Also present were Martin Schwartz, Textured Home Restoration and Building Contractors, and Karen Robinson, Wright Robinson Architects. Leon and Karen Weaver, property owners, were also present to answer the Boards questions.
Attorney Cuggino gave a brief presentation as to the details of the proposed addition, maintaining a hardship of no alternative location for the addition due to wetland issues, the angle of the house and curve of the property. The addition will not impact the existing footprint of the structure or visual proximity of neighboring properties. Martin Schwartz spoke briefly, stating that relief was sought due to lot constraints beyond the control of the property owner. Karen Robinson stated that it made the most sense to place the addition, which is a proposed exercise room, next to the lap pool. All neighbors contacted were in support of the project. One neighbor was present, Joan DeSalvo, 115 Mountain Road. Ms. DeSalvo spoke in support of the project. Mr. and Mrs. Weaver also spoke briefly. A variance was granted previously
for a similar addition on this property.
Deliberative Session
The Board voted unanimously to enter Deliberative Session at 8:28 p.m.
During deliberative session, Board members determined that there were alternate locations on the property where the addition could be placed, that would not violate the setback. No hardship could be determined.
The Board voted unanimously to exit Deliberative Session at 8:31 p.m.

On motion of Mr. Morton and second of Ms. Williams, the Board voted unanimously to deny the application based on lack of hardship.
The Board voted unanimously to adjourn at 8:32 p.m.
