MEETING MINUTES
MARCH 17, 2009—8:00 P.M.

The meeting was called to order at 8:00 p.m.
REGULAR APPLICATIONS:
0309-1: 298 Black Rock Turnpike, Susan and Stephen DiAmico, Owners/Applicants: Request for variance to reduce side yard setback from required 40 feet to 33.5 feet for a pool.
Susan DiAmico presented the application to the Board and answered their questions. Mrs. DiAmico explained that before the existing pool was constructed, the Town map on file from 1961 at Town Hall was used to determine setback requirements for the location of the proposed pool. The map on record gave a side yard setback of 70 feet, and the pool was built based on this measurement, which Mrs. DiAmico assumed was accurate as it was on file with the Town.
After the pool was constructed, an A2 survey was required, and this survey showed a side yard setback of 60.7 feet. The new survey also shows the amount of acreage to be 2.29 acres, opposed to the map on file with the Town, which shows total acreage to be 2.26 acres.
Jim Upton, 302 Black Rock Turnpike is the northern abutting property owner who was present in support of the requested variance.
Deliberative Session
The Board voted unanimously to enter Deliberative Session at 8:20 p.m.

The Board discussed suggestions as to possible procedural revision to avoid this occurring in the future. The applicant consulted the map on file with the Town in good faith and was not aware of any discrepancy in measurements.
After careful consideration, upon motion of Ms. Litoff and second of Mr. Morton, the Board voted to grant the requested variance to reduce side yard setback from required 40 feet to 33.5 feet for a pool, based on unusual hardship.
The Board voted unanimously to exit Deliberative Session at 8:29 p.m.
The Board voted unanimously to adjourn at 8:29 p.m.
These minutes have not been approved by the ZBA.
