ZONING BOARD OF APPEALS
MEETING MINUTES
DECEMBER 16, 2008—8:00 P.M.

The meeting was called to order at 8:00 p.m.
REGULAR APPLICATIONS:
1208-1: 10 Sunnyview Drive, Donald and Judith McKenna, Owners/Applicants: Requesting a variance to Sec 4.6.5(b), a 20 foot variance for a shed to be 20 feet from side.
Donald and Judith McKenna were present to answer questions. The application was denied without prejudice in September 2007, and the Board asked Mr. and Mrs. McKenna to get review from the Conservation Commission, and to also consider alternate locations on their property for placement of the shed.
At their September 18, 2008 meeting, the Conservation Commission determined that no regulatory issues existed, and asked only that no dirt be brought in to fill in the wetlands, and that the shed have no foundation, but be placed on crushed stone. Mr. McKenna provided a copy of the minutes from that meeting, which were added to the record.
Mr. McKenna contended that due to the severe slope of the property, wetland issues and non-conformity of the property were all contributing hardships.
Steve and Janice Pomazi, 85 Sunset Hill Road, spoke in opposition to the proposed location of the shed. Mr. Pomazi also had questions as to building permit requirements and was directed to the Zoning Enforcement Officer and Building Department. Mrs. Pomazi suggested turning the shed and placing it elsewhere on the property, not in close proximity to the property line.
Steve Pomazi, Jr., 12 Sunnyview Drive, suggested moving the shed closer to the house at 10 Sunnyview Drive.
Deliberative Session
The Board voted unanimously to enter Deliberative Session at 8:28 p.m.
1208-1: 10 Sunnyview Drive
After careful consideration, upon motion of Ms. Litoff and second of Mr. Thompson, the Board voted to deny the requested variance for Sec 4.6.5( b), based on lack of hardship. The Board determined that there were other alternatives within the setback requirement that could be considered.
The Board voted unanimously to exit Deliberative Session at 8:32 p.m.
The Board voted unanimously to adjourn at 8:32 p.m.
These minutes have not been approved by the ZBA.
