ZONING BOARD OF APPEALS
MEETING MINUTES
OCTOBER 21, 2008—8:00 P.M.

The meeting was called to order at 8:00 p.m.
Mr. Bronson noted the absence of Ms. Litoff and Mr. Thompson. Mr. Given and Mr. Polio were seated.
REGULAR APPLICATIONS:
1008-2: 16 Howes Lane, Beverly Hall, Applicant: request variance to Sec 4.6, reduce side yard setback from 40 feet to 25 feet for construction of a shed.
Mr. Bronson recused himself and Ms. Williams was appointed Chair for this application.
Beverly Hall, Applicant was present to answer questions for the Board. Ms. Hall explained that the existing structure was in poor condition and needed to be replaced. She provided photographs of the existing structure. It currently is used to store lawn equipment and garden tools. The proposed structure is a pre-built shed that will be delivered by truck and placed on the blacktop driveway that is the current location of the existing structure. The proposed structure is the same size as the existing structure. The hardship claimed is the proximity of wetlands and the location of the septic system. Ms. Hall had contacted all of her neighbors by letter, and all were in support of the project. Tom Boucher, 24 Deer Spring Road, was present and spoke in support of the proposed shed.
1008-3: 27 Olmstead Road, Michael and Karen Conroy, Applicants: request variance to Sec 8.1.221(c), to reduce rear yard setback from required 50 feet to 41 feet for construction of an addition.
Michael and Karen Conroy were present to answer questions from the Board. The lot is non-conforming and Mr. and Mrs. Conroy claim topographical hardship due to location of the septic system and proximity of ledge rock. They provided photographs of the proposed area.

1008-1: 24 Tudor Road, Robert Fried, Applicant; request variance to Sec. 4.6, to reduce side yard setback from required 40 feet to 34.5 feet.
Robert Fried was present to answer questions from the Board. Mr. Fried stated that when he tried to get a Certificate of occupation for his pool, it was discovered that the pool shed that had been constructed was in violation of setback regulations. The shed had been constructed 5 feet larger than the plans had indicated. Mr. Fried claimed topographical hardship, noting a drainage issue. There was one letter of support read into the record, from Ronald Sellers, 19 Tudor Road.
Deliberative Session
On motion of Mr. Given and second of Mr. Morton, the Board voted unanimously to enter Deliberative Session at 9:02 p.m.
1008-2: 16 Howes Lane
After careful consideration, the Board determined that no hardship existed.
Upon motion of Mr. Morton and second of Mr. Given the Board voted unanimously to deny the request based on lack of hardship.
1008-3: 27 Olmstead Road
After careful consideration, the Board determined that a topographical hardship existed.
Upon motion of Mr. Given and second of Ms. Williams the Board voted unanimously to approve the request if the footprint remained as is for topographical hardship and the Bilco door was moved no closer than the distance to the corner of the existing building.
1008-1: 24 Tudor Road
After careful consideration, the Board determined that no hardship existed. The Board suggested that the shed be turned, as long as it was 5 feet narrower than it was long. A land swap with abutting neighbors was also suggested so as to extend possible alternate locations for the shed.
Upon motion of Ms. Williams and second of Mr. Bronson the Board voted unanimously to deny the request based on lack of hardship.
The Board voted unanimously to exit Deliberative Session at 9:17 p.m.
Upon a motion made by Ms. Williams, and seconded by Mr. Morton, the Board voted unanimously to adjourn at 9:17 P.M.
The next ZBA Meeting is scheduled for November 18, 2008.
