The meeting was called to order at 8:00 p.m.
REGULAR APPLICATIONS:
0508-1: 40 Lonetown Road, Gregorio Pools and Spas, Agent-Request variance for Sec. 4.6.5b, reduce side yard setback from 40 feet to 38.5 feet, and Sec. 4.6.5c, reduce rear yard setback from 50 feet to 48.2 feet.
Tim Fraher from Gregorio Pools returned to present additional information for this application, originally presented in April. In review, the barn needed to be relocated to install a pool, and when the foundation was measured for its new location, the measurements were taken from the center of the driveway, when it should have been measured from closer to the edge of the driveway. The barn is old and after being moved once, may not survive another move. Part of the documentation needed for this meeting was proof of possible historical significance of the barn through hearsay, which could affect the need for a variance. Although extensive research was done, sufficient evidence of historical value of the barn could not be found.
Mr. Fraher did bring documentation from a contractor, stating that the barn's structural integrity would be compromised if another move was attempted.
0508-2: 3 Main Street, Michael Calise, Owner-Request variance for Sec 5.6.2 to allow use of municipal parking to fulfill requirements.
Mr. Calise presented the application to the Board. The building was placed in its present location after the flood of 1955. Mr. Calise bought the building in 1981 and it has been a real estate agency since that time. He rented space to the Acorn Press in the 1990's, and they moved out last July. A variance for parking is now necessary to use the building as a salon business. The present parking area is on the west side of the building. Other area business's also use these spaces. There are approximately 15 parking spaces available. Mr. Calise said that he has a pre-existing, non-conforming building that has been operating for more than 50 years in the same location, and the new zoning plan for the Georgetown downtown area should not affect him until such time that he does a renovation to conform to it. Each individual on the street has
the right to either adopt the new plan or not adopt it. The site is also too small to provide parking. Mr. Calise has issue with the regulations and that there is no clear definition with a change of use with respect to parking.
The building is on town property and the parking area is on state property. The town has no jurisdiction over state owned property.
Deliberative Session
The Board voted unanimously to enter Deliberative Session at 8:40 p.m.
0508-1: 40 Lonetown Road
After careful consideration, upon motion of Mr. Given and second of Ms. Williams, the Board voted to deny the application based on lack of hardship.
0508-2: 3 Main Street
After careful consideration, upon a motion by Mr. Given and second of Mr. Thompson, the Board voted unanimously to deny the application without prejudice. The motion was withdrawn
Upon motion of Mr. Thompson and second of Ms. Williams the Board voted unanimously to take no action on this application because of no underlying ruling from the Zoning Enforcement Officer or Zoning Commission.
The Board voted unanimously to exit Deliberative Session at 8:50 p.m.
The Board voted unanimously to adjourn at 8:52 p.m.
