ZONING BOARD OF APPEALS
MEETING MINUTES
APRIL 15, 2008-8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:00 p.m.

REGULAR APPLICATIONS:

0408-1: 40 Lonetown Road, Gregorio Pools and Spas, Agent-Request variance for Sec. 4.6.5b, reduce side yard setback from 40 feet to 38.5 feet, and Sec. 4.6.5c, reduce rear yard setback from 50 feet to 48.2 feet.
Tim Fraher and Ernie Zavaky from Gregorio Pools and Spas presented the application to the Board. Mr. Fraher explained that the property line runs at an angle with dual access to the shared property. Mr. Fraher said that an existing barn had to be moved to allow for construction of a pool on the property. The site for the new foundation for the barn was measured from the center of the neighboring property's driveway, instead of from the angle. The barn was moved, creating a violation of the regulation by way of the overhang. There would still be a setback violation if the overhangs were removed. Mr. Fraher does not think that the barn will withstand another move back. The barn may also have some historic significance. The applicant provided no evidence of this, only hearsay.
Well and septic locations limit the location of the proposed pool.

Ms. Williams read a letter into the record from the Klumpps, the abutting property owners, which stated that they were not in opposition of the location of the barn.

Deliberative Session
 The Board voted unanimously to enter Deliberative Session at 8:25 p.m.

0408-1: 40 Lonetown Road, Gregorio Pools and Spas, Agent

After careful consideration, the Board determined that proof of historic significance could be relevant. Potential destruction of a historic structure could be considered.

On motion of Ms. Litoff and second of Mr. Morton the application was denied without prejudice pending more research into the historic nature of the barn.




The Board voted unanimously to exit Deliberative Session at 8:27 p.m.



Upon a motion made by Mr. Morton, and seconded by Ms. Williams, the Board voted unanimously to adjourn at 8:30 P.M.
