ZONING BOARD OF APPEALS
MEETING MINUTES
JULY 17, 2007—8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:00 p.m.

REGULAR APPLICATIONS:

0607-1: 2 Bald Rock Road, Cornelia Hurwitz, Owner: Request variance to Sec 4.6, reduce rear yard setback from 50 feet to 12 feet, and Sec 3.13, non-conforming area.

Doug MacMillan, architect for Ms. Hurwitz, presented the application to the Board. The property borders open space in the rear. The applicant claims that the hardship is the existing location of the house and the change in the zoning regulations with regard to the rear yard setback. The intent is to build a screened porch on top of an existing deck. Septic and wetlands issues prohibit putting the porch in any other location. At the time the house was built, in 1981, there was a 25 foot setback, and the deck was constructed. Current regulations prohibit construction of a porch on the existing deck.
The porch extends closer to the property line than the house.
Mr. MacMillan contends that a past case in another Connecticut town had a similar variance request and that it was granted based on the change in zoning regulations after the structure was built. The Board asked that he supply this information at the next meeting.

After recalculating, Mr. MacMillan now had realistic numbers that kept the square footage of the addition within the 25% rule.

Upon a motion by Ms. Williams, seconded by Mr. Thompson, the Board voted unanimously to enter deliberative session at 8:30 P.M.


DELIBERATIVE SESSION:

0707-2: 2 Bald Rock Road:

After discussion and careful consideration and upon motion by Ms. Cotton, seconded by Mr. Morton, the Board voted 5-0 to Grant the request to reduce the rear yard setback to 38 feet for the office addition based on satisfaction of the square footage requirement

0707-1: 2 Bald Rock Road:

After discussion and careful consideration and upon motion by Mr. Bronson, seconded by Ms. Williams, the Board voted 5-0 to postpone their decision until further information is received, to include the specific ruling with regard to a change in zoning regulations being considered a hardship and that decision being upheld.


Upon a motion made by Mr. Bronson, and seconded by Ms. Williams, the Board voted unanimously to exit deliberative session at 8:35 P.M.

Upon a motion made by Mr. Morton, and seconded by Ms. Williams, the Board voted unanimously to adjourn at 8:35 P.M.
