The meeting was called to order at 8:00 p.m.
REGULAR APPLICATIONS:
0507-1: 53 Peaceable Street, Geoffrey Schur, Owner: Request variance to Sec 3.8(a), a request to waive 10 foot minimum setback requirement for a driveway from a property line.
This application was withdrawn prior to the meeting.
0507-2: 41 Blueberry Hill Road, Amy and Andreas Nonnenmacher, Owners: Request variance to Sec 4.6, item 5(a), reduce front yard setback by 6 feet.
Mr. Nonnenmacher presented his application to the Board. His architect, Victor Lazzaro, also spoke with regard to the application. Mr. Nonnenmacher would like to extend 6 feet into the present setback. There is a footing (4.5 feet deep X 6.5 feet wide) and step overhang that he would like to enclose a 3 foot X 8 foot portion of.
There is a non-conforming interior staircase that would be made safer if the front entrance way could be extended. Currently, the bottom of the staircase is 4 feet from the front door, and the stairs are very steep. The increased space will allow a proposed renovation with a reconfigured, more gradual staircase.
Other options for moving the staircase have been considered, but headroom restrictions limit these options.
0507-3: 2 Kimberly Drive, Dyal and Daisy Mahadeo, Owners: Request variance to Sec 4.6, subsection 5, reduce front yard setback from 40 feet to 9 feet.
Mr. and Mrs. Mahadeo presented their application to the Board. They would like to construct a 12 foot X 20 foot shed on their property. There is an existing 12 foot X 16 foot shed in another location on the property, used to store tools. This structure is 40 feet from the property line. The lot is sloped and narrow in some areas. There are other area’s that the shed could be placed that the homeowner believes to be too sloped or too narrow that would not impact the present setback.
Upon a motion by Ms. Williams, seconded by Ms. Litoff, the Board voted unanimously to enter deliberative session at 8:36 P.M.
DELIBERATIVE SESSION:
0507-2, 41 Blueberry Hill Road:
Mr. Given recused himself from voting on this application.
After discussion and careful consideration, the Board determined that there is an interior safety factor to consider.
Upon a motion by Mr. Morton, seconded by Ms. Williams, the Board voted 4-0 to grant the requested variance to allow a 40 foot setback based on exceptional difficulties and the hardship of safety factor.
0507-3, 2 Kimberly Drive:
After discussion and careful consideration, the Board determined that there were other locations on the property that a shed could be constructed that will not impact the setback.
Upon a motion by Ms. Williams, seconded by Mr. Morton, the Board voted 5-0 to deny the request for variance to 4.6 subsection 5 based on the existence of alternate sites on the property and lack of credible hardship.
Upon a motion made by Ms. Litoff, and seconded by Mr. Given, the Board voted unanimously to exit deliberative session at 8:42 P.M.
Upon a motion made by Ms. Litoff, and seconded by Ms. Fahan, the Board voted unanimously to adjourn at 8:42 P.M.
These minutes have not been approved by the ZBA.
