TOWN OF REDDING
ZONING BOARD OF APPEALS
MEETING MINUTES
DECEMBER 20, 2005—8:00 P.M.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:05 P.M.

REGULAR APPLICATIONS:

1205-1: 169 Picketts Ridge Road, 169 Picketts Ridge Road, LLC, Owner: request variance to Sec. 4.6.5, to reduce side setback from 40 feet to 39 feet, 2 inches.
The applicant was not present. The application was not heard.

1205-2: 73 Diamond Hill Road, Mike Pilato, Applicant: request variance to Sec. 4.6, Schedule of Requirements Sub Item 5 Minimum Building Setbacks (b) Side Yard in feet is requested. Requesting a variance to reduce a side yard setback from 50 feet to 4 feet to build a small arbor over an existing patio and a 10 foot side yard setback for a small, built in grill.

Mike Pilato presented the application to the Board. The property is adjacent to two town owned properties, and the area in question is itself adjacent to town property. A variance was granted in September for the same area. Mr. Pilato explained that there is currently a dispute between the builder and surveyor.  Stakes were placed on put on property line to install a fence, but placed 10 feet onto town property.
The arbor has not been installed yet, and the location of the grill can be moved.

Upon a motion by Ms. Williams, seconded by Ms. Litoff, the Board voted 5-0-0 to enter deliberative session at 8:15 P.M.

DELIBERATIVE SESSION:

1205-2: 73 Diamond Hill Road:

The Board is concerned with granting an additional variance on a variance that has already been granted for the same thing. The Board is also concerned about the proximity of the grill area to open space, and the possibility of a fire hazard.

                Upon a motion made by Ms. Litoff, seconded by Ms. Williams, the Board voted                     5-0-0 to deny the request, based on insufficient hardship, a safety issue, and the                      inability to grant a variance closer than a previously granted variance.

                Upon a motion made by Ms. Cotton, seconded by Ms. Williams, the Board                   voted to exit deliberative session at 8: 16 P.M.

        Upon a motion made by Ms. Cotton, and seconded by Mr. Morton, the Board voted 5-0-0     to adjourn at 8:16 P.M.
