ZONING BOARD OF APPEALS
MEETING MINUTES
OCTOBER 18, 2005—8:00 p.m.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:00 p.m.

A correction in the minutes from September 20, 2005 will be as follows:
Application # 0905-3, Sec. 5.12.4(b) will be corrected to 5.12.5(b).

REGULAR APPLICATIONS:

1005-1: 331 Black Rock Turnpike, Ellsworth and Cheryl Jones, Owners—request variance to Sec. 4.6, Entitled Schedule of Requirements; Subsection 5, Minimum Building Setbacks, request backyard variance from 50 feet to 32 feet, total variance 18 feet from property line to construct a deck;
Mr. Jones has applied for a variance, but also needs feedback from the Conservation Commission, which he did not yet have at this meeting.
This application will be postponed until the November 15, 2005 meeting, as feedback from the Conservation Commission is required before hearing this application.

1005-2: 63 Turney Road, Robert and Nancy Rosa, Owners—request variance to Sec. 5.12.3 B, allow loft to remain 1145 square feet, approve as is, and variance to Sec. 5.12.5 D, reduce rear yard setback from 100 feet to 60 feet, approve location of building as is;

Mr. Rosa presented his application. He requests that a loft space being used as a living space for a family member remain at its present size. The barn structure was built in 1996. Initially, the space was used by Mr. Rosa as a studio, and he never intended for the space to be used as an apartment, but a family member has been living there in an 1145 square foot space, which includes a small kitchen area.  It was explained that there is a 600 square foot maximum for an accessory apartment. Mr. Rosa is willing to comply with the 600 foot maximum regulation for an accessory apartment. If a wall is constructed, the space must be non-accessible from the existing apartment.

Mr. Rosa will return at the next meeting with a floor plan for the reduced space, and to request the variance for the setback line.

1005-3: 35 Whortleberry Road, Eric and Jenny Seal, Owners-- request variance from Sec. 3.8 subsection C, Minimum Sight line distance at 15 feet back from travel way of frontage road: 250 feet to approaching vehicles on road to request 50 feet to the east and 30 feet to the west;
Mrs. Seal presented her application to the Board. Mrs. Seal explained that she wants to reduce the curve of her driveway, as the entry/exit is a very tight curve. Slope requirements and drainage issues were the only concerns, and Mrs. Seal has met those requirements.

1005-4: 22 Peaceable Street, Roman and Melissa Horicka, Owners—request variance to reduce front yard setback from 50 feet to 28 feet.
The applicant was not present at the meeting. The application was not heard.

        
        Upon a motion by Ms. Williams, seconded by Ms. Litoff, the Board voted 5-0-0    to      enter deliberative session at 8:25 p.m.

DELIBERATIVE SESSION:
1005-2: 63 Turney Road, Robert and Nancy Rosa, Owners—request variance to Sec. 5.12.3 B, allow loft to remain 1145 square feet, approve as is, and variance to Sec. 5.12.5 D, reduce rear yard setback from 100 feet to 60 feet, approve location of building as is;
        
        Upon a motion made by Mr. Given, seconded by Ms. Williams, the Board voted      5-0-0   to deny the variance, and request the applicant return in November with         sufficient      documentation.

1005-3: 35 Whortleberry Road, Eric and Jenny Seal, Owners-- request variance from Sec. 3.8 subsection C, Minimum Sight line distance at 15 feet back from travel way of frontage road: 250 feet to approaching vehicles on road to request 50 feet to the east and 30 feet to the west;

        Upon a motion made by Mr. Morton, seconded by Ms. Williams, the Board voted     5-0-0   to grant a variance to Sec. 3.8 subsection C, reducing the eastern sightline    by 50 feet and  the western sightline by 30 feet.

        Upon a motion made by Mr. Bronson, and seconded by Ms. Williams, the Board      voted   to exit deliberative session at 8: 30 p.m.

        Upon a motion made by Mr. Bronson, and seconded by Ms. Williams, the Board      voted   5-0-0 to adjourn at 8:32 p.m.
