ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, APRIL 19, 2005—8:00 p.m.
TOWN HALL HEARING ROOM

The meeting was called to order at 8:20 p.m.

The following applications/appeals will be postponed until the May, 2005 hearing:
0305-1: Pamela Gould, 151 Topstone Road--appeal from an order to cease and desist from an alleged violation of Sec. 3.8 of the Zoning regulations issued on January 11, 2005.
0405-2: Michael Greenberg and Associates, Applicant, 123 Mountain Road—requesting variance to Sec. 4.6 and Sec. 5.12.4, to allow the use of a garage building as a detached accessory apartment with a front setback of 17.6 feet and a side setback of 49.7 feet.

0105-5: Anne and Robert Whitney, Owners, 76 Simpaug Turnpike—request variance to Sec. 4.6, (5a), reduce front yard setback from 50 feet to 8 feet.
Mr. and Mrs. Whitney presented their application. The applicants had incorrectly estimated the distance of their request and revised it to 8 feet out from the present building, which is 25 feet from town property. Mr. Whitney stated that he would like to move his front door over, remove an existing stair and install steps. A small roof over the entranceway is also planned. There would be no extension except the outside steps. The application originally presented in January, 2005, and the applicants were asked to return with better documentation. A survey map which gave more information was supplied for this meeting.  The applicant states that the size of the lot and proximity to the road are presenting difficulty to relocate the steps. Location of the septic and well also impact consideration of another location.

0405-1: Michael Pilato, Owner, 6 Church Street South—request variance to Sec. 4.6, #5, Minimum Building Setback, reduce from 15 feet to 12 feet (side yard).
Mr. Pilato presented his application.  He proposes to enlarge a kitchen and dining room on the first floor and build a new bedroom on the second floor. The addition will be built on an existing foundation. There will also be an overhang. Mr. Pilato was told that the overhang would not be a problem.
Mr. Pilato read a letter into the record, from a neighboring property owner, Nina Whitcomb. Also read was a letter from Bennett and Stephanie Fletcher, from Church Street South. Neither have objection to Mr. Pilatos’ plans.

A motion to enter deliberative session was made, seconded and carried unanimously at 8:55 p.m.

0105-5: Anne and Robert Whitney, Owners, 76 Simpaug Turnpike—request variance to Sec. 4.6, (5a), reduce front yard setback from 50 feet to 8 feet.

After careful consideration and discussion, a motion was made to grant a request to go no closer than 17 feet to the road, with a hardship of small lot size and safety issues. The motion was seconded and carried unanimously.

0405-1: Michael Pilato, Owner, 6 Church Street South—request variance to Sec. 4.6, #5, Minimum Building Setback, reduce from 15 feet to 12 feet (side yard).
After careful consideration and discussion, a motion to grant a variance that the new overhang does not extend any greater than 2 feet past present footprint was made, seconded and carried unanimously.

The motion to exit deliberative session made, seconded and carried unanimously at 8:58 p.m.
