TOWN OF REDDING
ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, JANUARY 18, 2005—8:00 PM

05-0101: Margo Gross, Owner, 174 Black Rock Turnpike—request variance to Sec. 4.6(5b) reduce side lying setback from 40 feet to 9.6 feet to allow for an addition.
The property is a half acre parcel and adjacent to the Redding Ridge Cemetery. The addition will not disturb the neighboring property. The well is on the south side of the house, preventing any addition there. Ms. Gross presented her application. She explained that an extension in front of house of a 12’ X 20’ room is planned. She would also like to add a story to a 20’ X 20’ area at the rear of the house, and was told this was not a ZBA issue, as it was on a current footprint and does not require a variance. The proposed extension would come within 9.6 feet of the boundary adjacent to the cemetery property. Presently there are full grown maple trees and a privet hedge bordering the property line. The applicant would consider installing fencing if necessary. A letter from Henry McQuade, President of Redding Ridge Cemetery Association was read into record by Ms. Gross. Mr. McQuade expressed no objection to the extension of the house, but suggested moving the accessory structure (shed) to a more central location on the property, creating less of a visual impact from the cemetery.  

05-0102: Anne and Robert Whitney, Owners, 76 Simpaug Turnpike—request variance to Sec. 4.6, (5a), reduce front yard setback from 50 feet to 8 feet. The structure is an older house approximately 28 feet from the road. Mr. and Mrs. Whitney presented the application. Mr. Whitney stated that he would like to move his front door over, remove an existing stair, install steps, raise a small flat roof and install a portico. There would be no extension except the outside steps and portico. There was no survey map provided, and the board advised the applicant to have a survey done for a more exact calculation of the measurement to the road, as there is difficulty determining the distance from the current steps to the property line.28 feet from road, present steps are 24 feet from road. The applicant will re-apply with proper documentation.

The motion to enter deliberative session was made, seconded and carried unanimously at 8:56.

05-0101: Margo Gross, Owner, 174 Black Rock Turnpike—request variance to Sec. 4.6(5b) reduce side lying setback from 40 feet to 9.6 feet to allow for an addition.
After careful consideration, the board determined that the location of the well on the right, and the septic in the rear left very little expansion room. It was also determined that an additional foot be taken into account for the variance, as there will be a slight roof overhang on the extension. The motion to grant a variance from 40 feet to 8 feet 6 inches associated with the house addition, based on topographical hardship, with the installation of appropriate screening subject to approval of the Redding Ridge Cemetery Association was made, seconded and carried unanimously.

After careful consideration, the board determined that the accessory shed can be moved to a more central location, and reduced in size from 25’ X 30’ to 24’ X 28’.
A motion to grant accessory building based on the unusual hardship being the size and shape of the lot. changing the dimensions from 25’x30’ to 24’x28’, centered in the lot, with a 10 foot variance on either side was made, seconded and carried unanimously.

05-0102: Anne and Robert Whitney, Owners, 76 Simpaug Turnpike—request variance to Sec. 4.6, (5a), reduce front yard setback from 50 feet to 8 feet. Denied without prejudice.


The motion to exit deliberative session was made, seconded and carried unanimously at 9:03.
The motion to adjourn was made seconded and carried unanimously at 9:03 p.m.

The next ZBA meeting is scheduled for Tuesday, February 15, 2005, at 8:00 p.m.
