MINUTES

Tuesday, December 9, 2008
8:00 p.m. – Old Town House

Present:  Diane Taylor, Chairman; Michael Bakanas; Robert Dean; Thomas Flagg; Nancy King; Jerry Sarnelli, Alt.; Toby Welles, Alt.

Also present:     Jo-an Brooks, Land Use Coordinator
                         John Hayes, Town Planning Consultant

The Chairman called the meeting to order at 8:10 p.m.  D. Taylor stated that the meeting scheduled for 12/8/08 was cancelled due to the lack of public notice.

I.          PUBLIC HEARING CONTINUED: Deadline to Close or Extend
Resubdivision Application #519, 90 Black Rock Turnpike.  Noice Properties LLC, Stephanie Churchill, 4/132 acres into two lots.  Received 10/14/08.  Public Hearing opened 11/11/08.

Mr. and Mrs. Churchill were present along with M. Lillis, C.C.A.  D. Taylor read the following new letters and reports into the record:

-11/20/08 letter from W. and K. Oppenheimer
-11/24/08 letter from D. Hartline, Redding Health Dept.
-11/25/08 report from Milone & MacBroom
-11/11/08 letter from M. Lillis in response to consultant comments

Written comments from K. von Jena, Aquarion and Highway Dept. are forthcoming.

M. Lillis read D.O.T. information re: curb cuts.  In response, M. Lillis stated that the sight distance profiles have increased to 500 feet.  He submitted ten copies of the plan along with D.O.T. report and reviewed the sight distance profiles accompanied by drawings.  D.O.T. requests a 20-foot drainage easement from Route 58 to the wetlands.

J. Hayes reviewed his report and noted outstanding deficiencies in the application.  

Mrs. Churchill reviewed the reason for designing the driveways as proposed.

A 35-day extension was requested of the applicant.  The Public Hearing will continue at the next meeting.

II.     APPROVAL OF MINUTES     -Meetings of 11/19/08; 11/25/08

On the motion of R. Dean and the second of M. Bakanas, the Commission voted unanimously to approve the 11/19/08 Meeting Minutes.

III.    ADMINISTRATIVE
Final Revisions to Town Plan of Conservation & Development:  Discussion

Final revisions were made.  M. Bakanas will forward the final Plan in PDF format.  Plan to be approved at the 12/17/08 Public Hearing on approval.

IV.     PENDING
1.  Traffic Calming Methods. Discussion of T. Welles’ 6/12/08 draft.

Discussion will continue on a future agenda.

2. Complaints: Topstone Road, Marie Convertito; Umpawaug Road, Robert & Nancy Kaye; Sidecut Road, Dr. Liebowitz.  Discussion re: T. Welles letter(s).  Pictures received from Mrs. Convertito and letters to Dr. Liebowitz.  Possible Discussion.

Dr. Liebowitz was present.  T. Welles read letters addressing the concerns of Mrs. Convertito, Dr. Liebowitz and the Kaye’s.

On the motion of T. Flagg and the second of M. Bakanas, the Commission voted unanimously to forward the letters along with a cover letter to N. Ketcham, First Selectman and B. Sanford, Highway Dept.

3.  Reference Application #424, Lot #2, 3 Charlie Hill Road.  Robin Garavel owner.  Issue referred to Counsel.  Possible Discussion.

D. Taylor read her report on the 12/11/08 meeting with Maryanne Guitar and Dave Pattee a letter dated 12/9/08 from M. Guitar.
On the motion of D. Taylor and the second of T. Flagg, the Commission voted to request Counsel to notify Mrs. Garavel that the three easement holders have agreed to enforce the easement, shared by the three owners of the property, Redding Land Trust, Conservation Commission and Planning Commission, provided the cost incurred will be shared equally.  M. Bakanas abstained.


V.      CHAIRMAN’S REPORT
1. C.C.M. “Planning for Agriculture” Thursday, 12/11/08.  Meeting at Weston Town Hall, 10:00am-12:00 pm.  

J. Hayes will attend and submit a report.

2. Noise pollution information.

D. Taylor noted that Zoning will not be pursuing further action.

On the motion of N. King, the Commission voted unanimously to adjourn the meeting at 11:07 p.m.
