MINUTES

Tuesday, February 27, 2007

8:00 p.m. - Old Town House

Present: Diane Taylor, Chairman; Robert Dean, seated at 8:10 p.m.; Nancy King; Donald Stroetzel; Michael Bakanas, Alt.; Thomas Flagg, Alt., seated for G. Meyer; Toby Welles, Alt.

Absent: Greg Meyer

Also present: Jo-an Brooks, Land Use Coordinator

The Chairman called the meeting to order at 8:02 p.m.

On the motion of D. Taylor and the second of N. King, the Commission voted unanimously to add Item VII., the Zoning Referral concerning the amendment to the Zoning Regulations Section 4.2, Active Adult Residential Village for our discussion.

I.  APPROVAL OF MINUTES -Meeting of 1/23/07
                                Site Walk 1/28/07 GLDC



On the motion of D. Stroetzel and the second of T. Flagg, the Commission voted unanimously to approve the 1/23/07 Minutes as corrected:   Page 2, Item 2., change to "Proposed Amendments to Subdivision Regulations Section 4.1"; Page 2, Item 2., second paragraph, last sentence, change to " D. Taylor provided a history of the notices and scheduled Public Hearings of this matter noting that there has been generous time and opportunity for concerns to be submitted."



        On the motion of T. Flagg and the second of N. King, the Commission voted               unanimously to approve the 1/28/07 Site Walk Minutes.

II.  PUBLIC HEARING CONTINUED

Subdivision Application #513, Barry Finch, "Laurel Acres", 52 Mountain Road.  Proposed subdivision of 5.63 acres into two lots.  Received 11/28/06.  Presentation 12/12/06.  Site Walk 1/13/07.  Public Hearing opened 1/23/07.  Deadline to close 2/27/07. 

Mr. Finch was present along with M. Mazzucco, P.E.    D. Taylor noted receipt of a letter of extension.  The following new letters and memorandums were read into the record:

-memo dated 2/23/07 from M. Mazzucco re: letter of extension
-letter dated 7/31/01 from S. Reeve, resubmitted from previous application
-phone call dated 2/27/07 from B. Sanford, Highway Dept.
-letter dated 1/27/07 from C. Couch
-letters dated 2/11/07 from M. Mazzucco

M. Mazzucco will clarify the specific area for recommended archaeological survey per C. Couch.   

Mr. Mazzucco was instructed to contact the Fire Department directly regarding their recommendation to install a fire tank.  Mr. Finch reported that an in-ground water tank does not affect home insurance rates.

M. Mazzucco reviewed the revisions to the plans accompanied by various maps and drawings.   

Discussion will continue at the next meeting pending receipt of reports from J. Hayes and N. Burnham.

Subdivision Application #512, Frank Marini, "Lillian Estates", 417 Rock House Road.  Proposed subdivision of 17.76 acres into three lots.  Received 11/28/06.  Presentation 12/12/06.  Site Walk on individual basis.  Public Hearing opened 1/9/07.  Deadline to close 2/13/07.  Continued to 2/27/07 per letter of extension.  Deadline to close 3/13/07.

Mr. Marini was present along with Atty. P. Gelderman, R. Ochman and intervenors Mr. and Mrs. Oppenheimer and L. Zielinski.

D. Taylor read the following reports and letters into the record:

-report dated 2/23/07 from N. Burnham
-report dated 2/27/07 re: drainage calculations
-report dated 2/27/07 from J. Hayes  
-1/15/06 letter from the Redding Fire Department was validated by B. Sanford on 2/27/07
-memo dated 2/5/07 from the Redding Conservation Commission re: open space
-memo dated 2/5/07 from the Inland Wetland Commission  

On the motion of R. Dean and the second of T. Flagg, the Commission voted unanimously that the Oppenheimer Notice of Intervention is in order.

On the motion of N. King and the second of D. Stroetzel, the Commission voted unanimously that the Zielinski Notice of Intervention is in order.

On the motion of R. Dean and the second of N. King, the Commission voted unanimously that the McElaney Notice of Intervention is in order.

D. Taylor requested that the intervenors amend their notice of intervention letters with the change from three to two lots.  Mr. Zielinski noted errors in the revised plans.

Revised plans were reviewed accompanied by various maps and drawings.  Demolition/abandonment details re: driveway to the poolhouse need to be shown on the plans. 

W. Oppenheimer referenced reports submitted in 2000 by David Scott re: bedrock.  He read his letter dated 2/27/07.  L. Zielinski stated that a 12-foot driveway was approved by the Conservation Commission but noted that the plans include a 16-foot driveway.  R. Ochman clarified that the present gravel drive extends to 18 feet but the proposal includes a 16-foot driveway.  D. Taylor read the special conditions on the Conservation Commission license approving a 16-foot driveway.

The Public Hearing will continue at the next meeting.



III.  ADMINISTRATIVE



1.      Reference Application #490, Scott and Jennifer Estabrook.  Request to remove tree to enlarge garage and add a family room.  Fill a dry well.

Mr. and Mrs. Estabrook were present along with Sam Callaway.  Mr. Callaway reviewed the proposal and submitted photographs of the tree proposed to be removed.  Site Walks will be conducted on an individual basis.

2.      Restoration of Umpawaug Road.  T. Welles, M. Bakanas.  Update.

No new information or discussion.  Awaiting comments from N. Burnham re: road widening.

3.      Accessory Apartment Legislation.   D. Stroetzel.  Action for legislative session.

A bill proposed by the Homes CT Group concerning housing for economic development was discussed.  Discussion will continue.

4.      Historic Preservation.

No new information or discussion.



IV.  TO VOTE.  COMMISSIONERS DISCUSS MODIFICATIONS AND  CONDITIONS OF APPROVAL OR REASONS FOR DENIAL.    INPUT FROM PUBLIC AT PUBLIC HEARING ONLY.



Request from property owners to preserve the name Costa Lane.

After considerable deliberation, on the motion of D. Taylor and the second of N. King, the Commission voted to have the private lane Costa Lane renamed Carter Lane at the time of its acceptance.  Three in favor, two against.



VI.  CHAIRMAN'S REPORT

1.      Volunteers to report on Scenic Road monitoring tonight and second meeting of every month.

Commissioners reported on their road inspections.  No problems noted.

2.      CT Federation of Planning & Zoning Affordable Housing 3/22/07, CT Bar Association 3/17/07 and CT Land Coalition 3/31/07.

3.      Scenic Road signs.   

Per a report from B. Sanford, sign installation continues.



VII.  Zoning Referral concerning the amendment to the Zoning Regulations Section        4.2, Active Adult Residential Village



The Commission reviewed the proposed amendment and J. Hayes' report.  Discussion will continue at the next meeting.




        On the motion of T. Flagg and the second of N .King, the Commission voted       unanimously to adjourn the meeting at 11:15 p.m.
