MINUTES

Tuesday, January 9, 2007

8:00 p.m. - Old Town House

Present:  Diane Taylor, Chairman; Robert Dean; Nancy King; Greg Meyer; Donald Stroetzel; Thomas Flagg, Alt.; Toby Welles, Alt.

Absent: Michael Bakanas, Alt.

Also present:   Jo-an Brooks, Land Use Coordinator
                Natalie Ketcham, First Selectman

The Chairman called the meeting to order at 8:05 p.m.

I.  APPROVAL OF MINUTES-        Meeting of 12/12/06



On the motion of R. Dean and the second of G. Meyer, the Commission voted unanimously to approve the 12/12/06 Meeting Minutes.



II.  PUBLIC HEARINGS TO OPEN

1.      Request from property owners to preserve the name Costa Lane.

Residents and property owners on Costa Lane were present.  D. Taylor stated that all maps and documents and qualifications of the consultants were hereby incorporated into the public record on the request to preserve the name Costa Lane.

D. Taylor read a letter dated 1/9/07 from L. McCready in support of the name change.

Tom White, 2 Costa Lane, noted his concerns regarding databases using Costa Lane.  He stated that the name change cannot improve the health, safety and welfare of the residents.  Mary Jane White reported on her concerns including the inability of people including repairmen to locate Carter Lane on a map.  She also stated that per the Post Office, Costa Lane would no longer exist.

Michelle Delmore noted the inconveniences to the residents; Mr. and Mrs. Walsh, 6 Costa Lane,  described the potential financial impact of changing the address on business contacts.  J. Dooley, 3 Costa Lane, noted his concerns and stated that the name is not being changed but being deleted from existence.  Commissioners made comments.  D. Taylor stated that it is up to the Commission to determine if an inconvenience is a threat to health, safety and welfare.  She stated that Costa Lane has been a private road not recognized as a town road.  When it became part of a subdivision, Subdivision Regulations apply including the change of name. 

D. Taylor noted that all Commissioners are volunteer, elected officials who make honest and fair decisions that follow the Regulations.  She confirmed that any Commissioners would have to recuse themselves if their mind was made up prior to consideration of an application. 

On the motion of D. Stroetzel and the second of N. King, the Commission voted unanimously to close the Public Hearing.

2.      Proposed Amendments to Subdivision Regulations Section 4.1.

Deferred to 1/23/07.

3.      Subdivision Application #512, Frank Marini, "Lillian Estates", 417 Rock House Road.  Proposed subdivision of 17.76 acres into three lots.  Received 11/28/06.  Presentation 12/12/06.  Site Walk on individual basis.

Mr. Marini was present along with Atty. P. Gelderman and R. Ochman.  D. Taylor read the procedure on filing a Notice of Intervention and the subsequent charge to determine if claims are relevant.

The following new letters and reports were read into the record:

D. Taylor stated that any data previously submitted on prior applications must be resubmitted for the current application.

Atty. Gelderman presented a plan for a two-lot subdivision and responded to some of the issues brought up in letters read by D. Taylor.  D. Taylor confirmed that it is within the scope of an application to reduce the number of lots without filing a new application.

R. Mattes, 10 Spur Road, and L. Zielinski, 14 Spur Road, noted their concerns about future development on the property. 

The Public Hearing will continue at the meeting of 2/13/07.   



III.  ADMINISTRATIVE

1.      Scenic Road Complaint, 58 Marchant Road, Althea Piteo.

D. Taylor read an email forwarded to the Commission and the Redding Pilot from an anonymous source.  Photographs were reviewed and possible remediation was reviewed.  Discussion will continue pending attendance by Ms. Piteo.

2.      Restoration of Umpawaug Road-T. Welles, M. Bakanas. Update.

No new information or discussion.

3.      Accessory Apartment Legislation. Discussion.  Preparation for next legislative session.  D. Stroetzel.  Update.

D. Stroetzel is representing the Commission at a meeting on 1/11/07 sponsored by Sen. Freedman.



IV.  TO VOTE: COMMISSIONERS DISCUSS MODIFICATIONS AND   CONDITIONS OF APPROVAL OR REASONS FOR DENIAL    INPUT FROM  PUBLIC AT PUBLIC HEARING ONLY.     



1. Resubdivision Application #511, Georgetown Land Development Company, 1 North Main Street.  Proposed resubdivision of approximately 2 acres into 3 lots.  Received 9/26/06.  Public Hearing opened 10/10/06, continued 10/24/06, 11/14/06 extended to 11/28/06.  Public Hearing closed 11/28/06, subject to receipt of consultants' reports.  Deadline to vote meeting of 1/23/07.

On the motion of D. Taylor and the second of R. Dean, the Commission voted unanimously to approve Resubdivision Application #511 subject to the standard and special conditions attached and on file at the Land Use Office.

2. Proposed Building Line for west side of Main Street, Georgetown.

On the motion of D. Taylor and the second of D. Stroetzel, the Commission voted unanimously to approve the proposed building line on the west side of Main Street Georgetown as shown on the maps prepared by John Hayes.



V.  PENDING

1. Subdivision Application #513, Barry Finch, "Laurel Estates", 52 Mountainside Road.  Proposed subdivision of 5.63 acres into two lots.  Received 11/28/06.  Presentation 12/12/06. Site Walk 1/13/07. Public Hearing scheduled for 1/23/07.

No new information or discussion.



VI.  CHAIRMAN'S REPORT



1.      Commissioner's qualifications/areas of expertise.  A few still outstanding.

2.      Scenic Road signs installed where needed?   
D. Stroetzel has been informed by B. Sanford that a technical problem halted the installation but the Highway Dept. is still working on it.

3.      Historic Preservation.  R. Dean, T. Flagg. Public meeting scheduled for 1/21/07 at the Community Center.

4.      Volunteers to monitor Scenic Roads.   
Members volunteered for specific road assignments for monthly monitoring.




On the motion of G. Meyer and the second of R. Dean, the Commission voted unanimously to adjourn the meeting at 11:22 p.m.
