REGULAR MEETING

Present: Diane Taylor, Chairman; Robert Dean; Nancy King; Greg Meyer, seated at 8:05 p.m.; Donald Stroetzel; Thomas Flagg, Alt., seated at 8:02 p.m.; Toby Welles, Alt., seated for G. Meyer until 8:05 p.m.
Absent: Michael Bakanas, Alt.
Also present: Jo-an Brooks, Land Use Coordinator
The Chairman called the meeting to order at 6:02 p.m.
On the motion of D. Taylor and the second of R. Dean, the Commission voted unanimously to recess into Executive Session to discuss litigation on Application #504. Counsel, Peter Olson and Jo-an Brooks were requested to attend.
On the motion of D. Taylor and the second of R. Dean, the Commission voted unanimously to come out of Executive Session at 8:00 p.m.
The Chairman called the regular meeting to order at 8:01 p.m.
I. APPROVAL OF MINUTES -Meeting of 6/26/07
On the motion of D. Stroetzel and the second of R. Dean, the Commission voted unanimously to approve the 6/26/07 Minutes as corrected: Page 1, second paragraph under "Approval of Minutes", second line, change to "to approve the 6/16/06 Site Walk Minutes, #9, Sunnyview Drive."; Page 2, Item 6. change to "N. Burnham has referred this item to Tony Ciriello."; Page 3, Item "4.", change "Designated Scenic Roads" to "Designated Scenic Road."
II. ADMINISTRATIVE
1. Mail Coach Road - Historic Easement. K. von Jena.
K. von Jena was present. She reviewed the possibility and reasons for a historic preservation easement. J. Brooks will review with Counsel and discussion will continue.
2. Reference Application #459, Hedgerow Reserve, Lot #9, 32 Sunnyview Drive. J. Slattery and M. Holmes. Evergreens planted. Deciduous not planted yet. Discussion of drainage problems.
R. Dean provided an update on the recent site inspections by the Zoning Enforcement Officer. Per T. Gormley, a violation cannot be pursued due to improved current conditions and lack of evidence.
A letter will be written and copied to T. Gormley re: current findings and future action.
3. Reference Application #424, Lot #2, 3 Charlie Hill Road. Paul Garavel owner. Redding Planning Commission letter sent 5/7/07. Site Walks on individual basis.
Mr. Garavel was present. He reviewed the action taken to secure contractors to move trees. D. Taylor reiterated the request to remove the specified plantings and masonry in a timely fashion and suggested starting with the smaller items i.e. stone word and forsythia. Mr. Garavel was asked to submit a time schedule outlining his plans for removal of required items.
4. Town Plan of Conservation & Development. John Hayes. Discussion.
J. Brooks reported that J. Hayes is compiling statistics on land use for discussion at the next meeting.
5. Scenic Road Monitoring reports including signs.
Commissioners reported on Scenic Road observations. Reports show no complaints except: 1) T. Welles reported on work at the Shivarick property on Poverty Hollow Road. He will request information from the contractor on site. 2) D. Taylor read a status report from Bruce Sanford re: Poverty Hollow Road. 3) No remediation has been accomplished at 58 Marchant Road. 4) No work has been done at the Mark Twain Lane intersection. 5) One sign is incorrect at Topstone Road.
6. Road Regulations.
Report pending. Discussion upon receipt of report from Tony Ciriello, Milone & MacBroom.
7. Referral from Zoning: 4 Old Mill Road. For receipt.
No information or discussion.
8. Scenic Road Alteration, 229 Umpawaug Road. Reference Application #447. New stone pillars - gate. Discussion.
N. King reported on location and style of pillars and gate. The need for standards was discussed. A letter will be forwarded reminding Mr. Jacobson of the conditions set forth in the original approval.
9. Umpawaug Road boulders.
D. Taylor read an update from B. Sanford. T. Welles will investigate if the proposal for posts and cable includes wooden posts as preferred. Discussion will continue.
III. PENDING
1. Scenic Road Alteration. Request to rebuild wall, 233 Umpawaug Road. Robert Far owner.
No new information or discussion.
2. Scenic Road Alteration. Request to rebuild wall and landscape, 48 Cross Highway.
No new information or discussion.
3. Scenic Road Alteration. Request for alteration of Mark Twain Lane by Highway Superintendent to improve sight line. Letter sent 7/2/07.
Per B. Sanford, work will commence the last week of August. A letter will be sent re: Planning requirements. The Highway Dept. is seven weeks behind schedule due to storms
4. Intersection of Marchant and Chestnut Woods, Designated Scenic Road. Plan by Georgina Scholl and Nicolle Burnham. Letter sent 7/2/07.
D. Taylor read a report from Tony Ciriello, Milone & MacBroom detailing alternatives. T. Welles exhibited the plans. He will discuss alternative plantings with G. Scholl.
Commissioners felt trees would be damaged by large trucks. They will investigate historical evidence of past plantings. Discussion will continue.
5. Scenic Road Complaint, 58 Marchant Road, Althea Lockwood. Modifications approved 1/23/07. Reminder letter sent 7/2/07. Ivy planted. Needs removal of arch and additional plantings.
N. King reported that a small amount of ivy has been planted. Other required work has not been done.
6. Poverty Hollow Road, a Designated Scenic Road. Highway Department ditch reconstructed. Road milled. Letter sent 7/2/07.
B. Sanford will chip seal on 7/12/07.
IV. CHAIRMAN'S REPORT
D. Taylor submitted data on a symposium on the principles for drainage for local roads.
T. Welles reviewed the effectiveness of lateral communication vs. following the chain of command.
On the motion of N. King, the Commission voted unanimously to adjourn the meeting at 10:18 p.m.
