MINUTES

Tuesday, November 28, 2006

Old Town house - 8:00 p.m.

Present: Diane Taylor, Chairman; Robert Dean; Nancy King: Donald Stroetzel, seated until 8:35 p.m.; Michael Bakanas, Alt., seated for G. Meyer; Thomas Flagg, Alt., seated for D. Stroetzel at 8:35 p.m.; Toby Welles, Alt.

Absent: Greg Meyer

Also present: Jo-an Brooks, Land Use Coordinator

The Chairman called the meeting to order at 8:05 p.m.

I.  APPROVAL OF MINUTES -Meeting of 11/14/06

        On the motion of R. Dean and the second of M. Bakanas, the Commission voted  

Unanimously to approve the 11/14/06 Meeting Minutes as corrected: Page 2, fourth paragraph under Item "III.", last line, change "management" to "manageable"; Page 2, last paragraph, first line, change to "The original applicant needs to file an amendment to the subdivision approval and a public hearing will be scheduled pending receipt of the filing"; Page 4, first item under "PENDING", change "Sunnyview Dr." to "Sunnyview Drive";  Page 4, third item under "CHAIRMAN'S REPORT", change "schedules" to "scheduled'.



II.  PUBLIC HEARING TO CLOSE OR EXTEND

Resubdivision Application #511, Georgetown Land Development Company, 1 North Main Street.  Proposed resubdivision of approximately 2 acres into 3 lots.  Received 9/26/06.  Public Hearing opened 10/10/06, continued 10/24/06, 11/14/06 extended to 11/28/06.

Atty. Richard Gibbons was present along with members of the GLDC team.  Revised plans have been received. D. Taylor noted receipt of new information which was read into the record:

-report dated 11/27/06 from Milone & MacBroom
-letter dated 11/25/06 from K. von Jena
-memo dated 11/28/06 from John Hayes

The request to extend the Public Hearing was noted.

T. Gallagher from Tighe & Bond addressed the revisions in the plans.

On the motion of R. Dean and the second of N. King, the Commission voted unanimously to close the Public Hearing subject to receipt of final comments from consultants on materials recently submitted.



III.  PUBLIC HEARING CLOSED

Proposed Building Line for west side of Main Street, Georgetown.  Addendum to report on parking and septic feasibility, John Hayes.

J. Hayes has no further comments.



IV.  ADMINISTRATIVE

1.      Application by Town of Redding for alterations to Poverty Hollow Road, a Designated Scenic Road.  T. Welles, M. Bakanas.  Site Walk 4/22/06.  Highway Department request to construct ditch.

A letter will be sent to B. Sanford at the Highway Department.

2.      Reference Application #507, Adam Lubarsky, 80 Laurel Lane.  Request to alter Lot Development Plan.

Mr. Lubarsky was present.  He reviewed his request and was commended by D. Taylor for his efforts in saving a landmark tree.  D. Taylor read a report from N. Burnham and comments from J. Hayes.

On the motion of R. Dean and the second of M. Bakanas, the Commission voted unanimously to approve the request to alter the Lot Development Plan subject to the existing recorded maps being referenced on any new maps that will be recorded.

3.      Reference Application #459, Hedgerow Reserve, Lot #9, 32 Sunnyview Drive.  Site Walks on individual basis to approve stakes.  Plantings approved.

A letter will be send reiterating the requests discussed at the previous meeting.

4.      Reference Application #479, Mangini, Lot #2, 76 George Hull Hill Road.  Request to move well radius 9' beyond lot boundary.

Phil Dolcimascolo was present.  He reviewed the proposal accompanied by drawings.

On the motion of N. King and the second of R. Dean, the Commission voted unanimously to approve the new well location as shown on the map by Land Tech revised 11/6/06.

5.      Reference Application #447, Herman, 229 Umpawaug Road.  Stone wall mock-up disapproved per individual site walks.  New mock-up needed.

D. Taylor reported that the new mock-up will be ready on 12/2/06 for inspection.  Commissioner's comments should be emailed to the Land Use Office.

6.      Reference Application #459, Hedgerow Reserve, Lot #8, 33 Sunnyview Drive.  Dr. S. Sherman.  Site Walks on individual basis.  Engineer's drainage plan to be completed.

Discussion tabled pending receipt of drainage information.

7.      Referral from Selectmen: Notice of proposal for Spring PCS 120-ft. cell tower at 186 Black Rock Turnpike, Redding Ridge Fire House, to replace existing 75-ft. tower.  Comments to Vanasse Hangen Brustlin, Inc. in regard to "effect on historic properties" must be postmarked no later than December 16, 2006.

D. Taylor noted receipt of a letter dated 11/8/06 from Vanasse Hangen Brustlin forwarded by N. Ketcham.  A report dated 11/25/06 from K. von Jena was read by D. Taylor. 

A letter will be forwarded to N. Ketcham concurring with K. von Jena's report and noting that because of the existing appropriately sized flag pole and another in close proximity,  it would be redundant to place another flag pole especially since the size of these poles are very large in diameter and the flags are outsized proportionately.

8.      Restoration of Umpawaug Road - T. Welles, M. Bakanas.  Update.

No new information or discussion pending update from B. Sanford.

9.      Accessory Apartment Legislation.  Discussion.  Preparation for next legislative session.  D. Stroetzel.  Update.

No new information or discussion.

10.     Proposed Amendments to Subdivision Regulations Section 4.1.  Discussion.   Set Public Hearing date.
The Public Hearing was scheduled for 12/12/06.  D. Taylor stated that the proposed amendments to Section 4.1.1, 4.1.4a and 4.1.9a are to clarify existing regulations, not to add new regulations.



ADDENDUM
APPLICATIONS FOR RECEIPT:  NO DISCUSSION: SCHEDULE PRESENTATION



1.  Subdivision Application #512, Frank Marini, "Lillian Estates", 417 Rock House Road.  Proposed subdivision of 17.76 acres into three lots.

On the motion of M. Bakanas and the second of R. Dean, the Commission voted unanimously to receive Subdivision Application #512.

The presentation was set for 12/12/06.

2.  Subdivision Application #513, Barry Finch, "Laurel Estates", 52 Mountain Road.  Proposed subdivision of 5.63 acres into two lots.

On the motion of N. King and the second of T. Flagg, the Commission voted unanimously to receive Subdivision Application #513.

The presentation was set for 12/12/06.



V.  PENDING

1.  Pending:  Reference Application #501 Modification.  New retaining wall causing erosion and siltation on adjacent property.  Nicolle Burnham report #2.  Hay bales, silt fence and filter fabric installed.  Top of wall graded.  Will call when seeded.

2. Pending: Suggestions for Historic Preservation.  R. Dean, T. Flagg.  Kathleen von Jena update.
3.  Pending: Request from owners to preserve the name Costa Lane.  Public Hearing to open 12/12/06.




VI.  CHAIRMAN'S REPORT



D. Taylor reported on a proposed settlement for Mountainside Estates subject to receipt of plans.  An Executive Session will be scheduled prior to the scheduled 12/12/06 court date.

A possible second curb cut was noted on Sidecut Road and will be investigated.

T. Welles is the Commission liaison for the GIS Committee.  Commissioners should forward suggestions for specific information to be included on the maps to T. Welles.

The seemingly excessive driveway width on the Ryder Farm subdivision on Umpawaug Road was noted.




On the motion of T. Flagg and the second of N. King, the Commission voted unanimously to adjourn the meeting at 10:05 p.m.
