MINUTES

 

Tuesday, March 28, 2006

8:00 p.m. - Town Hall Hearing Room

 

Present:  Diane Taylor, Chairman; Robert Dean; Nancy King; Greg Meyer; Donald Stroetzel; Thomas Flagg, Alt.

 

Absent:  Michael Bakanas, Alt.; Toby Welles, Alt.

 

Also present:    Jo-an Brooks, Land Use Coordinator

                        Natalie Ketcham, First Selectman

                        John Hayes, Town Planning Consultant

 

The Chairman called the meeting to order at 8:00 P.M.

 

I.  APPROVAL OF MINUTES           -Meeting of 3/14/06

 

On the motion of D. Stroetzel and the second of N. King, the Commission voted unanimously to approve the 3/14/06 Meeting Minutes as corrected:  Page 1, under "Absent", change "Nancy King" to "Greg Meyer"; Page 3, second paragraph from the bottom, second line, change "who missed and portion" to "who missed any portion."

 

II.  TO VOTE: COMMISSIONERS DISCUSS MODIFICATIONS AND CONDITIONS OF APPROVAL OR REASONS FOR DENIAL.  INPUT   FROM  PUBLIC AT PUBLIC HEARING ONLY.

Subdivision Application #508, Georgetown Land Development Company, LLC, North Main Street.  Proposed subdivision of 45 acres into 106 lots.  Received 12/13/05.  Public Hearing opened 1/24/06, continued 2/28/06, closed 3/14/06. 

 

Steve Soler was present along with Atty. Richard Gibbons and one member of the GLDC team.  The Commission deliberated in detail on the findings.

 

On the motion of D. Taylor and the second of R. Dean, the Commission voted unanimously to accept the findings as corrected.

 

On the motion of D. Taylor and the second of R. Dean, the Commission voted unanimously to approve a waiver to the subsections of Subdivision Regulations Section 4.3 which concern right-of-way and travelway width, corner "rounding", intersection design and spacing and minor roads because the compact design of the street system within the urban center protects public health and safety by controlling vehicle speeds and encouraging pedestrian circulation as an alternative to local vehicle use.

 

On the motion of D. Taylor and the second of D. Stroetzel, the Commission voted unanimously to approve Subdivision Application #508 subject to the Commission's "Standard Modifications and Conditions of Approval" and the following Special Conditions as amended (attached and on file at the Land Use Office.)

 

III.  ADMINISTRATIVE

 

1.      Proposed Accessory Apartment Legislation.  Discussion of mailing.

 

D. Stroetzel read a draft letter to be sent to 141 small towns in Connecticut concerning proposed Accessory Apartment Legislation.  Estimated costs were also noted.

 

2.      Referral from Easton.  Proposed Amendments to Easton Zoning Regulations.

 

J. Hayes reported on the proposed Amendments re: building height restrictions on all buildings in all districts.  A letter will be forwarded stating that this proposed Amendment is not in conflict with the Town Plan of Conservation & Development.

 

IV.  APPLICATIONS FOR RECEIPT.

1.      Subdivision Application #509, "Lillian Estates", 411 and 417 Rock House Road.  Frank Marini (owner).  Proposed subdivision of 20.42 acres into 5 lots.

 

On the motion of R. Dean and the second of G. Meyer, the Commission voted unanimously to receive Subdivision Application #509.

 

2.      Subdivision Application #510, 25 Starrs Ridge Road.  Jay Addison (owner), Michael Mazzucco, P.C. (agent).  Proposed subdivision of 46.353 acres into 2 lots.

 

On the motion of D. Stroetzel and the second of N. King, the Commission voted unanimously to receive Subdivision Application #510.

 

V.  PENDING

1. Application by Town of Redding for alterations to Poverty Hollow Road, a designated Scenic Road.  Plans to be submitted by Highway Superintendent.

           

            No new information or discussion.

 

2.  Restoration of Umpawaug Road - Discussion.

 

No new information or discussion.

 

3.  Application to construct stone wall at 207 Poverty Hollow Road, a designated  Scenic Road.  James & Jeanne Billett, owners.  Brian Davis, agent.  Meeting of  3/28/06.

 

No new information or discussion.

 

4.  Subdivision Application #507, 80 Laurel FKA 6 Starrs Ridge Road.  Margaret and Abraham Alvarado (owners), Adam Lubarsky for 132 Redding Road, LLC (agent).  Proposed subdivision of 4.6 acres into 2 lots.  Received 12/13/05.  Public Hearing opened 2/14/06.  Site Walk 2/18/06.  Public Hearing continued 2/28/06.  Public Hearing closed 3/14/06.

 

            No new information or discussion.

 

VI.       CHAIRMAN'S REPORT

 

            No items.

 

 

On the motion of G. Meyer and the second of N. King, the Commission voted unanimously to adjourn the meeting at 11:10 p.m.
