EXECUTIVE SESSION
Pending Litigation, John Lambrech v. Redding Conservation Commission
Present: David Pattee, Chairman; William Hill; Frederick Schroeder; Wallace Perlman.
Absent: Jeremiah Ross; Joseph Beres; Victor DeMasi
Also present: Peter Olson, Commission Counsel
The Chairman called the meeting to order at 7:30 p.m.
On the motion of F. Schroeder and the second of W. Perlman, the Commission voted unanimously to go into Executive Session at 7:31 p.m.
On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to come out of Executive Session at 8:10 p.m.
The Regular Meeting reconvened at 8:11 p.m.
I. APPROVAL OF MINUTES -Minutes of September 21, 2010
On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve the 9/21/10 Minutes as submitted.
II. REGULATORY
Permit #07-32, John and Jennifer Lambrech, 336 Newtown Turnpike. Action on Notice of Violation and resolution of appeal.
John and Jennifer Lambrech were present in addition to Mr. and Mrs. Corning. D. Pattee noted receipt of reports from Rob Sibley, Tom Ryder and the Cornings.
On the motion of F. Schroeder and the second of W. Perlman, the Commission voted unanimously to rescind and revoke the action taken at its November 3, 2009 meeting which suggested that the property owner submit an application to remediate conditions in the pond on the neighboring property.
The Commission has reviewed reports from competent technical experts, as follows:
- Robert Sibley, of Sibley Professional Services, Sandy Hook, CT, dated August 9, 2010;
- Thomas Ryder, of LandTech Consulting, Westport, CT, dated August 9, 2010;
- Robert Sibley, dated September 22, 2010; and
- Thomas Ryder, October 5, 2010
The Commission has also reviewed submissions from Dwight and Nancy Corning, dated September 7, 2010 and October 5, 2010.
The Commission’s November 3, 2009 action was based on a concern that the property owner had not provided sufficient competent technical expert reports or testimony to establish that there were no significant short or long term adverse environmental impacts on the wetlands and watercourses located on the neighboring property, including the pond, as a result of the site activity on the Lambrech property.
Based on the expert reports which have now been submitted, the Commission now concludes that the site conditions caused by the activities which necessitated the Notice of Violation issued on July 21, 2009, are no longer present. Accordingly, no further action is required on the Notice, and it is hereby lifted.
III. CHAIRMAN’S REPORT
The Fairfield County Alliance will be meeting at the Town Hall on 10/20/10.
D. Pattee reported on bow hunting results in Redding and neighboring towns.
Metro North is withdrawing their application re: beaver dam.
CACIWC Annual Meeting is scheduled for 11/13/10 in Wallingford. Anyone interested in attending should contact C. Keil at the Land Use Office.
D. Pattee is attending the DEP Segment III on geospatial data and geographic information systems.
F. Schroeder reported that the field at Couch Hill Preserve has been cut and has ¼ remaining.
On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to adjourn the meeting at 8:40 p.m.
