MINUTES
Tuesday, November 3, 2009
7:30 p.m. – Old Town House
Present: David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Joseph Beres; Victor DeMasi; Wallace Perlman.
The Chairman called the meeting to order at 7:30 p.m.
I. APPROVAL OF MINUTES - Minutes of 10/20/09
Site Walk Minutes 10/25/09- Mr./Mrs. J. Billett, 207 Poverty Hollow Rd.
S. Strand, 61 Gallows Hill Road
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 10/20/09 Minutes.
On the motion of J. Ross and the second of W. Perlman, the Commission voted to approve the 10/25/09 Site Walk Minutes. W. Hill abstained.
II. REGULATORY
John Lambrech, 336 Newtown Turnpike. Erosion control. Discussion. Notice of Violation issued 7/22/09. Site Walk of Corning pond 7/24/09, 340 Newtown Turnpike. Discussion 8/4/09, 8/18/09, 9/15/09.
J. Lambrech was present along with R. Sibley and Mr. and Mrs. Corning. Mrs. Corning displayed and reviewed photographs along with a history of the conditions in the pond. Mr. Corning reviewed his data collection process. G. Nazzaro has visited the site and reported that dredging and pond restoration is feasible.
Mr. Sibley reviewed the remediation efforts of the Lambrech family. Mr. Lambrech reiterated the sediment and erosion control efforts taken during the last year.
A report from N. Burnham dated 3/23/09 was reviewed.
On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to request Mr. Lambrech to submit an application to clean the pond.
Application #09-20, Paul Shiverick, 226 Poverty Hollow Road. Received 7/7/09. Discussion and possible vote on an application for removal of deposited sedimentation within specified area of the Aspetuck River via long reach excavator or dragline. Site Walk 7/13/09. Discussion 8/18/09. Received letter granting 65-day extension. Discussion 9/15/09. Received letter to withdraw application dated 10/29/09.
Application has been withdrawn. New application forthcoming.
Application #09-25, Tom and Teresa Healy, 87 Marchant Road. Received 9/15/09. Discussion and possible vote on an application to construct a retaining wall and patio within the regulated area. Site Walk 9/18/09. Discussion 10/2/09. Application amended per letter dated 10/28/09.
Mr. Healy was present. He reviewed the changes to the original application and the engineered retaining wall.
On the motion of V. DeMasi and the second of J. Beres, the Commission voted unanimously to approve Application #09-25 with the stipulation that sediment and erosion controls be designated in red on the map.
Application #09-27, Jim and Jeanne Billet, 207 Poverty Hollow Road. Received 10/20/09. Discussion and possible vote on an application to build a one-story addition, terrace with pergola, pool terrace and installation of a swimming pool within the regulated area. Site Walk 10/25/09.
The architect and contractor for the applicant were present. Site Walk findings were reviewed.
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve Application #09-27.
Application #09-28, Sallie Strand, 61 Gallows Hill Road. Received 10/20/09. Discussion and possible vote on an application to install a new subsurface sewage disposal system to replace existing system within the regulated area. Site Walk 10/25/09.
S. Trinkaus was present for the applicant. Site Walk findings were reviewed.
On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve Application #09-28.
Application #09-29, Laura W. Ruggiero, 283 Umpawaug Road. To receive and discuss an application for driveway maintenance within the regulated area.
L. Ruggiero was present along with S. Herman. The proposal was reviewed and D. Pattee requested a narrative detailing sediment and erosion controls.
A Site Walk was scheduled for Sat., 11/7/09 at 9:00 a.m.
Discussion of Draft Inland Wetland and Watercourses Regulations 8/18/09; 9/1/09; 10/6/09; 10/20/09.
D. Pattee stated that the DEP has confirmed receipt of the Draft. The public notice schedule was reviewed and the Draft is posted on the Town website.
III. CHAIRMAN’S REPORT
D. Pattee reported on the deer harvest status listed on the DEP website as of 11/3/09.
On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 9:30 p.m.
