MINUTES

Tuesday, August 4, 2009
7:30 p.m. – Old Town House

Present: David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Victor DeMasi; Wallace Perlman.

Absent: Joseph Beres

The Chairman called the meeting to order at 7:30 p.m.

I.      APPROVAL OF MINUTES     -       Minutes of 7/21/09

On the motion of J. Ross and the second of W. Perlman, the Commission voted unanimously to approve the 7/21/09 Minutes.

On the motion of W. Perlman and the second of J. Ross, the Commission voted to approve the 7/14/09 Minutes.   W. Hill abstained.

II.     REGULATORY

Barry A. and Carole Smith, 4 Woodland Rive Ext. re: Disturbance to Regulated Wetland Area.  Discussion 4/21/09. Site Walk 4/26/09.  Discussion 5/5/09; 5/19/09; 6/2/09.

No one was present for the applicant.  C. Keil will contact Mr. Smith re: status.

Application #09-09, Joseph and Phyllis Liguori, 9 Sunset Hill Road.  Received 5/5/09.  Discussion and possible vote on an application to renovate current home and build an extension of the premises including site work for patio, stone walls and drainage, etc. within the regulated area.  Site Walk 5/11/09. Discussion 5/19/09, 6/2/09, 6/16/09, 7/7/09.   Received letter granting 65-day extension.  Discussion 7/21/09.

Mr. Liguori was present.  He provided an update re: construction debris removal and stated that it should be complete in 7-10 days.  Stone wall work will commence after completion of construction debris removal.  A couple of underground detention structures will be installed with the pipe being run under the driveway.  

A site inspection will be scheduled at the next meeting after further debris removal.  D. Pattee noted receipt of a 65-day extension.

Richard L. Newman, 3 West Woodland Drive. Re: Disturbance to Regulated Wetland Area.  Discussion 6/16/09.  Site Walk 6/23/09.  Discussion 7/7/09.

Mr. Newman was present.  He reported that hydroseeding will be done later this week.  D. Pattee requested Mr. Newman to either submit photographs along with a completion letter or attend the next meeting to update the Commission on the status.

John Lambrech, 336 Newtown Turnpike.  Erosion control.  Discussion.  Notice of Violation issued 7/22/09.  Site Walk of Corning pond 7/24/09, 240 Newtown Turnpike.

Mr. Lambrech and George Benson were present.  Mr. Benson stated that he is proposing hand-cleaning the stream course.  He reviewed his observations and stated that pond restoration is not required.  D. Pattee noted fallen trees and silt that need to be removed in addition to material including collected behind silt fences just west of the driveway.  The material should be put in a designated low area and seeded quickly. Mr. Benson confirmed that all the cleaning will be done by hand.

Mr. Lambrech confirmed that the cleaning will be done immediately.  Permission was granted by the Cornings to allow Mr. Lambrech or his consultant to clean the mouth of the pond on their property.  Mrs. Corning stated that silt has been flowing into the pond for one year and stated there is 1 ½ feet of material deposited in the pond.  D. Pattee questioned the feasibility of a temporary drawdown of the pond.

D. Pattee would like physical evidence that says either material has been deposited in the pond or not.  F. Schroeder stated that the burden of proof is on the applicant to convince the Commission that there hasn’t been a major deposition in the pond.

D. Pattee summarized that in the next week and a half, Mr. Lambrech will have the pond cleaned out behind the still-standing sediment and erosion systems; clean out all the silt from behind those systems; go through the stream corridor and clean out the stream corridor including the delta into the pond; clean through the woods by hand all of the material that has been deposited which has the opportunity to get resuspended.  B. Flanagan will be requested to visit the site and do another inspection.  This item will continue to be an open item until the Commission satisfied that there is no new material coming through and when a determination is made that either the pond needs to be corrected or it doesn’t.  In the meantime, Mr. Benson is urged to find a reasonably inexpensive but good procedure to make a determination about the status of the bottom of the pond and whether or not the material is relatively fresh or comprised of decayed vegetation.

Discussion will continue at the next meeting.

Application #09-20, Paul Shiverick, 226 Poverty Hollow Road.  Received 7/7/09.  Discussion and possible vote on an application for removal of deposited sedimentation within specified area of the Aspetuck River via long reach excavator or dragline.  Site Walk 7/13/09.

G. Nazzaro was present for the applicant.  He reviewed the project details which should take 30 working days.  Options re: deposition of removed silt were reviewed. Discussion will continue pending receipt of a report from Aquarion.

Application #09-21, Richard S. Basile, 21 Sunnyview Drive.  Received 7/21/09.  Discussion and possible vote on an application to clear land and install post and rail fence within the regulated area.  Site Walk 7/24/09.

Mr. Basile was present.   Site walk findings were reviewed.  Mr. Basile has requested M. Lillis to replace the stakes and boundary pins.  

On the motion of V. DeMasi and the second of J. Ross, the Commission voted unanimously to approve Application #09-21.

Application #09-22, William and Kathleen Oppenheimer (owners), Ralph Gallagher Jr. PE (agent), 457 Newtown Turnpike.  To receive and discuss an application to replace existing septic system within the regulated area.

R. Gallagher was present for the applicant. He reviewed the proposal to replace the existing possible dry well with an approved system.  

A site walk was scheduled for Fri., 8/7/09 at 5:30 p.m.  The ends of the proposed system should be staked.

Application #09-23, Vladimir Koltchine and Natalia Nikolaeva, 36 Umpawaug Road.  To receive and discuss an application for an inground swimming pool to include pool pad, children’s playhouse and associated grading.

Mr. Koltchine was present.  D. Pattee stated that the proposed pool is outside of the 100’  setback area, however, the proposed regarding is within the setback area.  D. Pattee informed Mr. Koltchine of the need to use a cartridge filter.

A site walk was scheduled for Fri., 8/7/09 at 6:00 p.m.  The four corners of the proposed pool should be staked.

III.    CHAIRMAN’S REPORT

D. Pattee has begun Regulations revisions and will be meeting with J. Ross on 8/5/09.  C. Keil will make copies for each Commissioner for their reference.

Re: Gordon property on Church Hill Road.  Will discuss at next meeting re: site inspection during dry season.

B. Dexter will be commencing work on the Unfried property within the next week.

Re: Temple in Georgetown, tree removal and construction status.


On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 9:25 p.m.
