MINUTES
Tuesday, July 21, 2009
7:30 p.m. – Old Town House
Present: David Pattee, Chairman; Jeremiah Ross; William Hill, seated at 8:08 p.m.; Frederick Schroeder; Joseph Beres; Victor DeMasi; Wallace Perlman.
The Chairman called the meeting to order at 7:35 p.m.
I. APPROVAL OF MINUTES -Minutes of 7/7/09

On the motion of W. Perlman and the second of F. Schroeder, the Commission voted to approve the 7/7/09 Meeting Minutes as submitted. J. Ross abstained.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve the 7/10/09 and 7/13/09 Site Inspection Minutes.
II. REGULATORY
Barry A. and Carole Smith, 4 Woodland Drive Ext. re: Disturbance to Regulated Wetland Area. Discussion 4/21/09. Site Walk 4/26/09. Discussion 5/5/09; 5/19/09; 6/2/09.
No one was present for the applicant. Per Mr. Smith, no work has been done due to weather conditions. Discussion tabled pending notification that work has commenced.
Application #09-09, Joseph and Phyllis Liguori, 9 Sunset Hill Road. Received 5/5/09. Discussion and possible vote on an application to renovate current home and build an extension of the premises including site work for patio, stone walls and drainage, etc. within the regulated area. Site Walk 5/11/09. Discussion 5/19/09; 6/2/09; 6/16/09.
No one was present for the applicant. D. Pattee reviewed a recent status report submitted by Mr. Liguori. Discussion will continue at the next meeting.
Richard L. Newman, 3 West Woodland Drive re: Disturbance to Regulated Wetland Area. Discussion 6/16/09. Site Walk 6/23/09. Discussion 7/7/09.
Discussion tabled pending attendance by Mr. Newman at the 8/4/09 meeting.
Application #09-14, Gregory and Deanna Wolff, 5 Quarry Rock Road. Received 7/7/09. Discussion and possible vote on an application to construct driveway and pool within the regulated area. Site Walk 7/10/09.
R. Gary was present for the applicant. D. Pattee noted receipt of and read a letter from Aquarion. The Commission concurred that the information in the Aquarion letter does not pertain to the proposed regulated activity on this application.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve Application #09-14.
John Lambrech, 336 Newtown Turnpike. Erosion control. Discussion.
Mr. Lambrech was present. D. Pattee reviewed an email and photos submitted by B. Flanagan. A letter from the pond consultant, George Benson, was submitted and reviewed. D. Pattee noted that it is necessary to determine what is in the pond prior to determining remediation measures. Mrs. Corning stated that there is 1-½ feet of mud in the pond.
Mr. Benson will attend the next meeting for discussion. A site inspection of the Corning’s pond is scheduled for Fri., 7/24/09 at 5:30 p.m. at 340 Newtown Turnpike.
On the motion of J. Ross and the second of F. Schroeder, the Commission voted unanimously to issue a formal Notice of Violation and require development of a remediation plan for the pond and immediate surrounding area and watercourses that feed the pond.
Application #09-15, Larry and Jane Biagini (owners), Nazzaro, Inc. (agents), 12 Huckleberry Road. Received 7/7/09. Discussion and possible vote on an application to restore existing pond. Site Walk 7/10/09.
G. Nazzaro was present for the application. A letter from Aquarion was reviewed in detail by Mr. Nazzaro.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve Application #09-15.
Application #09-16, Barbara Pape, 296 Black Rock Tpke. Received 7/7/09. Discussion and possible vote on an application for installation of curtain drain within the regulated area. Site Walk 7/10/09.
No one was present for the applicant. Site Walk findings were reviewed.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve Application #09-16.
Application #09-17, Richard Jarvis (owner), Peak Engineers, Inc. (agent), 39 Long Ridge Road. Received 7/7/09. Discussion and possible vote on an application for a building addition and designated septic replacement area within the regulated area. Site Walk 7/10/09.
No one was present for the applicant. Site Walk findings were reviewed.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve Application #09-17.
Application #09-18, Eric and Ritu Duenwald (owners), Todd Drury of TR Building (agent), 45 High Ridge Road. Received 7/7/09. Discussion and possible vote on an application to remove existing retaining wall and rebuild, add drainage pipe and riprap pad for storm drain. Site Walk 7/13/09.
Mr. Drury was present for the applicant. Site Walk findings were reviewed. D. Pattee stated that the exit pipe should enter into a plunge pool.
On the motion of J. Beres and the second of J. Ross, the Commission voted unanimously to approve Application #09-18.
Application #09-19, Kenneth Unfried (owner), William Dexter (agent), 97 Cross Highway. Received 7/7/09. Discussion and possible vote on an application for septic repair on leaching fields within the regulated area. Site Walk 7/13/09.
Mrs. Unfried was present. Site Walk findings were reviewed.
On the motion of F. Schroeder and the second of W. Perlman, the Commission voted unanimously to approve Application #09-19.
Application #09-20, Paul Shiverick, 226 Poverty Hollow Road. Received 7/7/09. Discussion and possible vote on an application for removal of deposited sedimentation within specified area of the Aspetuck River via long reach excavator or dragline. Site Walk 7/13/09.
Discussion tabled until the 8/4/09 meeting.
Review of plans for Costa Lane, Costa Stergue (owner). Regulated activity determination. Discussion 7/7/09. Site Walk 7/13/09.
Site Walk findings were reviewed. The Commission reviewed regulated activity criteria and will send a letter to Mr. Stergue noting that the Commission has determined that the recent activity does not constitute a regulated activity.
Application #09-21, Richard S. Basile, 21 Sunnyview Drive. To receive and discuss an application to clear land and install post and rail fence within the regulated area.
Mr. Basile was present. The proposed plan was reviewed accompanied by a drawing. M. Lillis has been requested by Mr. Basile to stake the wetlands boundaries.
A site inspection is scheduled for Fri., 7/24/09 at 6:00 p.m.
III. CHAIRMAN’S REPORT
On the motion of D. Pattee and the second of W. Perlman, the Commission voted unanimously to add the Georgetown Redevelopment Corporation and Georgetown Special Taxing District to the agenda.
Atty. R. Gibbons was present. The Revised Master Plan was displayed and the proposed changes reviewed. The Commission determined that a formal application is not required.
On the motion of V. DeMasi and the second of J. Ross, the Commission voted unanimously to adjourn the meeting at 9:40 p.m.
