MINUTES
Tuesday, July 7, 2009
7:30 p.m. – Old Town House
Present: David Pattee, Chairman; William Hill; Frederick Schroeder; Joseph Beres; Victor DeMasi; Wallace Perlman.
Absent: Jeremiah Ross
The Chairman called the meeting to order at 7:30 p.m.
I. APPROVAL OF MINUTES -Minutes of 6/16/09

Baldwin Family Ltd Partnership, 171 Sunset Hill Road.
On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve the 6/16/09 Meeting Minutes.
On the motion of J. Beres and the second of W. Perlman, the Commission voted unanimously to approve the 6/23/09 Site Inspection Minutes.
II. REGULATORY
Barry A. and Carole Smith, 4 Woodland Drive Ext. re: Disturbance to Regulated Wetland Area. Discussion 4/21/09. Site Walk 4/26/09. Discussion 5/5/09; 5/19/09; 6/2/09.
Discussion tabled pending notification by applicant that approved remediation has begun.
Application #09-09, Joseph and Phyllis Liguori, 9 Sunset Hill Road. Received 5/5/09. Discussion and possible vote on an application to renovate current home and build an extension of the premises including site work for patio, stone walls and drainage, etc. within the regulated area. Site Walk 5/11/09. Discussion 5/19/09; 6/2/09; 6/16/09.
Mr. Liguori was present. He provided an update on the progress of approved remediation. D. Pattee reported on B. Flanagan’s observations from his recent site visit.
Discussion will continue at the next meeting.
Application #09-11, Rod Cordle, 4 Rob Rider Road. Received 6/16/09. Discussion and possible vote on an application to install a 30” x 100’ retaining wall on north side of property within the regulated area. Site walk 6/23/09.
No one was present for the applicant. Site Walk findings were reviewed.
On the motion of J. Beres and the second of W. Perlman, the Commission voted unanimously to approve Application #09-11.
Application #09-13, Baldwin Family Limited Partnership (owners), Peak Engineers, LLC, Tom Quinn (agent), 171 Sunset Hill Road. Received 6/16/09. Discussion and possible vote on an application for designation of a B100 area within a regulated area. Remove and replace 8-feet of septic system and construct parking area. Site Walk 6/23/09.
T. Quinn was present for the applicant. A new drawing depicting the footing drain and fill location for driveway construction was reviewed.
On the motion of J. Beres and the second of V. DeMasi, the Commission voted unanimously to approve Application #09-13.
Richard L. Newman, 3 West Woodland Drive. Re: Disturbance to Regulated Wetland Area. Discussion 6/16/09. Site Walk 6/23/09.
Mr. Newman was present. He will provide an update at the first meeting in August, 2009.
Application #09-14, Gregory and Deanna Wolff, 5 Quarry Rock Road. To receive and discuss an application to construct driveway and pool with the regulated area.
Mr. Wolff and R. Gary were present. Mr. Gary noted that the application is for driveway and pool. A drawing was displayed and the proposal was reviewed.
A site walk was scheduled for Fri., 7/10/09 at 5:30 p.m. D. Pattee requested stakes at the ends of the proposed pool location.
John Lambrech, 336 Newtown Turnpike. Erosion control. Discussion.
Mr. and Mrs. Lambrech were present. Mr. Lambrech reported that the two remaining silt basins were removed and the area has been stabilized. Recent storm events have resulted in additional overflow into the neighboring pond. Photos taken 7/7/09 were reviewed.
D. Pattee reported on his site visit with B. Flanagan. Sediment and erosion controls should remain on the sides of the driveway until the final driveway surface is complete.
D. Corning questioned if the pond would be restored to its original condition. D. Pattee stated that details on pond restoration are pending a report by George Benson.
Discussion will continue.
Application #09-15, Larry and Jane Biagini (owners), Nazzaro, Inc. (agents), 12 Huckleberry Road. To receive and discuss an application to restore existing pond.
G. Nazzaro was present for the applicant. A drawing was displayed and the proposal reviewed.
A site walk was scheduled for Fri., 7/10/09 at 6:00 p.m.
Application #09-16, Barbara Pape, 296 Black Rock Tpke. To receive and discuss an application for installation of drainpipe within the regulated area.
T. Quinn was present for the applicant. He displayed a drawing and reviewed the proposal.
A site walk was scheduled for Fri., 7/10/09 at 6:15 p.m. The outlet of the existing pipe should be flagged.
Application #09-17, Richard Jarvis (owner), Peak Engineers, Inc. (agent), 39 Long Ridge Road. To receive and discuss an application for a building addition and designated septic replacement area within the regulated area.
Mr. Jarvis and T. Quinn were present. A drawing was displayed and reviewed by Mr. Jarvis.
A site walk was scheduled for Fri., 7/10/09 at 6:45 p.m. The four corners of the proposed garage should be staked.
Application #09-18, Eric and Ritu Duenwald (owners), Todd Drury of TR Building (agent), 45 High Ridge Road. To receive and discuss an application to remove existing retaining wall and rebuild, add drainage pipe and riprap pad for storm drain.
Mr. Drury was present for the applicant. A drawing was displayed and reviewed.
A site walk was scheduled for Mon., 7/13/09 at 5:30 p.m. The secondary drain line location should be staked.
Application #09-19, Kenneth Unfried (owner), William Dexter (agent), 97 Cross Highway. To receive and discuss an application for septic repair on leaching fields within the regulated area.
Mrs. Unfried and W. Dexter were present. Mr. Dexter displayed and reviewed the proposed septic repair plan.
A site walk was scheduled for Mon., 7/13/09 at 5:45 p.m. The two ends of the new leaching area should be staked.
Application #09-20, Paul Shiverick, 226 Poverty Hollow Road. To receive and discuss an application for removal of deposited sedimentation within specified area of the Aspetuck River via long reach excavator or dragline.
M. Lillis from CCA was present for the applicant. D. Pattee reviewed correspondence from Aquarion stating that they will be forwarded an engineering report.
After a review of the proposal, a site walk was scheduled for Mon., 7/13/09 at 6:00 p.m.
Review of plans for Costa Lane, Costa Stergue (owner). Regulated activity determination.
Costa Stergue was present along with Linda Fitzgerald, neighboring property owner. D. Pattee noted that this is a public meeting and not a public hearing. As such, only Mr. Stergue and Ms. Fitzgerald were permitted to speak. Criteria for regulated activity determination were reviewed by D. Pattee.
D. Pattee stated that Ms. Fitzgerald reported tree removal activity to B. Flanagan.
Mr. Stergue reported that he was removing trees for access to perform perc tests. Ms. Fitzgerald noted her concerns re: vernal pool and inhabitants. Mr. Stergue had been informed that mechanized equipment is not permitted.
A site walk was scheduled for Mon., 7/13/09 at 6:30 p.m.
III. CHAIRMAN’S REPORT
Purple loose strife removal was discussed. The Commission concurred that it is not necessary at this time.
D. Pattee reported on the Georgetown Streetscape project.
D. Pattee reported that the relationship with Fuss & O’Neill will cease after the current project is complete. The new GIS firm will be CDM.
On the motion of V. DeMasi and the second of F. Schroeder, the Commission voted unanimously to adjourn the meeting at 9:35 p.m.
