MINUTES

Tuesday, May 19, 2009
7:30 p.m. – Old Town House

Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Victor DeMasi; Wallace Perlman.

Absent: Joseph Beres

The Chairman called the meeting to order at 7:35 p.m.

I.      APPROVAL OF MINUTES             -Minutes of 5/5/09
                Site Inspections of 5/11/09     -Mr./Mrs. H. Gordon, 48 Church Hill Rd.
                                                -Mr./Mrs. J. Liguori, 9 Sunset Hill Rd.

On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve the 5/5/09 Meeting Minutes.

On the motion of W. Perlman and the second of J. Ross, the Commission voted to approve the 5/11/09 Site Inspection Minutes.  W. Hill abstained.

II.     EXECUTIVE SESSION       -To discuss potential resolution of Burton v. Redding Conservation

On the motion of J. Ross and the second of F. Schroeder, the Commission voted unanimously to table the Executive Session.

III.    REGULATORY

License #07-32, John and Jennifer Lambrech, 336 Newtown Turnpike.  Status on project progress.  Discussion 3/17/09; 4/7/09; 42109; 5/5/09.

Mr. Lambrech was present.  He updated the Commission re: status of the project.  D. Pattee noted receipt of and reviewed an email from B. Flanagan dated 5/19/09.

D. Pattee reviewed the following pending items needed for final stabilization: final gravel coat on driveway; remove dirt piles; remove temporary sediment basin; remove silt fence/hay bales; evaluate status of neighboring pond.

B. Flanagan will be requested to continue inspection and inform the Commission.
Barry A. and Carole Smith, 4 Woodland Drive Ext. re: Disturbance to Regulated Wetland Area.  Discussion 4/21/09. Site Walk 4/26/09. Discussion 5/5/09.

Mr. Smith was present.  Site Inspection findings were reviewed.  D. Pattee requested Mr. Smith to submit a drawing and narrative inclusive of how much material is present; how much material is proposed to be removed; where the material is being removed from.   The drawing should indicate the septic location.

Discussion will continue pending receipt of the narrative and drawing.

Application #09-08, Harold and Joan Gordon (owners), North Point Construction, Mark Giumarra, (agent), 48 Church Hill Road.  Received 5/5/09.  Discussion and possible vote on an application to repair/replace two existing clay pipes.  Site Walk 5/11/09.

Mr. Gordon and M. Giumarra were present.  Site Inspection findings were reviewed.  Mr. Giumarra reiterated the events leading to this application and his offer to replace the clay pipes as retribution for accidental tree removal.  Mr. Gordon stated that the water level in the pond has never been so high.

D. Pattee has reviewed photographs of the pond and stated that there has been no change in the size of the pond noted.  No information is available re: old pipe system.  

The pond will be evaluated during the dry season to inspect the water level.  Mr. Gordon will be notified in late July-early August of a repeat site inspection.  D. Pattee provided Mr. Gordon with a list of alternative fast-growing trees for replacement consideration.

Application #09-09, Joseph and Phyllis Liguori, 9 Sunset Hill Road.  Received 5/5/09.  Discussion and possible vote on an application to renovate current home and build an extension of the premises including site work for patio, stone walls and drainage, etc. within the regulated area.  Site Walk 5/11/09.

Mr. Liguori was present.  Site Inspection findings were reviewed.  Mr. Liguori was given permission to remove the excess stockpile; remove the surface drains and fill the trench; remove the crushed stone around the pipe and reinstall the original silt fence to the edge of the driveway.

Discussion will continue.

Application #09-10, Michael Whitehouse and Kim Hanna Whitehouse, 22 Pocahontas Road.  To receive and discuss an application for installation of closed-loop pond heat exchange for geothermal heat pump and construction of small tool shed.

Mr. Whitehouse was present along with the neighbor/pond co-owner, Mark Guss.  He reviewed his proposal and was informed that a license is not required for the shed if construction doesn’t involve earth moving.

A site walk was scheduled for Sat., 5/30/09 at 8:30 a.m.

IV.     CHAIRMAN’S REPORT

J. Ross reported that B. Flanagan is awaiting a response from Mr. Palmisano re: permission to visit the site.

D. Pattee is attending a GIS Subcommittee meeting on 5/28/09.

J. Ross reported that the new equipment shed has been installed.  Three new saw blades will be installed on the saw.

F. Schroeder requested volunteers for invasive species removal at Saugatuck
Falls, 5/30/09.

J. Ross requested volunteers for spreading mulch at Gilbert Miller Park in Georgetown, 5/23/09 at 9:00 a.m.  The rain date is 5/24/09.


On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 10:00 p.m.
