Tuesday, March 3, 2009
7:30 p.m. – Old Town House

Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Joseph Beres; Victor DeMasi; Wallace Perlman.

Absent:  Frederick Schroeder

The Chairman called the meeting to order at 7:30 p.m.

I.  APPROVAL OF MINUTES -Minutes of 2/17/09

On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 2/17/09 Minutes as amended: Add to the beginning of Page 2, “Application #08-25, Reeda B. Harsche, (owner), Three Levels Corporation (agent), 626 Redding Road. (the “Property”).

The above Application for License to Conduct Regulated Activities having been received by the Commission on August 5, 2008; and
~
The Commission having held a public hearing on the Application, commencing on November 18, 2008 and concluding on January 6, 2009; and
~
The Commission having received written communications and oral testimony from the Applicant and its professional consultants, as well as from members of the public; and
~
The Commission having received the following written communications from expert witnesses, which documents were made a part of the public record:

~~~a.~ Wayne Jacobsen: October 7, 2008, October 23, 2008, November 25, 2008, December 24, 2008 and January 6, 2009;

~~~~~~~b.~~ Russell Slayback: October 21, 2008, November 24, 2008, and January 2, 2009;

~~~~~~~c.~ James MacBroom:~ September 16, 2008, November 17, 2008, December 11, 2008, January 6, 2009, January 12, 2009 and January 28, 2009; and
~~~~~~~d.~ Thomas Ryder: September 12, 2008 and November 14, 2008.

It is hereby FOUND that:

1.~ The proposed regulated activities and other site development do not present a significant adverse environmental impact on the wetlands located on the northeast side of the Property and the adjacent property;
~
2.~ The proposed regulated activities and other site development do not present a significant adverse environmental impact on the wetlands located on the southeast side of the Property and the adjacent property;
~
3.~ The proposed regulated activities do, however, occur upgradient of and in the vicinity of the Saugatuck River, which is classified as a Class AA stream, and its associated wetlands system.
~
4.~ The Saugatuck River and the associated wetlands system, located on the western portion of the Property and the adjacent property are high value wetlands resources, and as such, the Commission has reviewed the proposed regulated activities to determine if they are likely to have an impact on such resources, pursuant to Regulations § 2.23.

Page 2, third paragraph, end of line 2, change “e” to “be”.

On the motion of W. Perlman and the second of J. Ross, the Commission voted to approve the 2/22/09 Site Walk Minutes.~ J. Beres and W. Hill abstained.

II.~~~~~~~~~~~ REGULATORY

Application #09-01, Donald and Linda Longo (owners), Environmental Land Solutions, Kate Throckmorton (agent), 710 Redding Road.~ Received 2/3/09.~ Discussion and possible vote on an application to install a swimming pool with associated site work including retaining walls, deck, patio and relocation of septic tank and pump chamber (includes spa) within the regulated area.

Kate Throckmorton was present for the applicant.~ Drawings were displayed and reviewed.~ Pool discharge details were submitted.

D. Pattee expressed concern about the close proximity of the construction activities to the wetland and requested a very defined construction sequence.~ Ms. Throckmorton will discuss pervious surface areas with the application for discussion at the next meeting.

Application #09-02, Timothy and Irene Brennan (owners), Michael F. Cusato, AIA (agent), 28 Bridle Road.~ Received 2/3/09.~ Discussion and possible vote on an application for an addition to residence, septic system and driveway within the regulated area.~ Site Walk 2/22/09.

M. Cusato was present along with Mr. and Mrs. Brennan.~ The presence of stones at the site of the proposed septic system were noted. The applicant was encouraged to place a vegetative buffer of native plants and shrubs at the edge of the pond.

On the motion of W. Perlman and the second of J. Beres, the Commission voted unanimously to approve Application #09-02.

Application #09-03, Carmine and Mary Ellen Frele (owners), Nazzaro Inc. (agent), 36 Great Meadow Road.~ Received 2/3/09.~ Discussion and possible vote on an application for pond restoration.

G. Nazzaro was present for the applicant.~ A drawing was displayed and reviewed.~ A site walk was scheduled for Sun., 3/15/09 at 8:30 a.m.

Application #09-04, 123 Mountain Road Associates LLC (owners), Peak Engineers LLC (agent), 123 Mountain Road.~ Received 2/3/09.~ Discussion and possible vote on an application for construction of stream crossing for driveway, construction of tennis court, open air pavilion, washroom.~ Installation of septic system and associated grading.~ Installation of private supply well.~ Site Walk 2/22/09.

T. Quinn was present for the applicant.~ Revised plans were displayed and reviewed.~ D. Pattee noted receipt of a letter from D. Hartline dated 2/23/09.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to approve Application #09-04.

Modification to License #05-20, Cedar Ridge LLC (owners), Nina Stietzel (agent), 676 Redding Road.~ Request to modify licensed activity description.

N. Stietzel was present.~ The history of the License was reviewed.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to change the activity description from “relocate the Chapman Historical House, 8 Limekiln Road” to “construct a house at 676 Redding Road.”


III.~~~~~~~~~~~ CHAIRMAN’S REPORT

D. Pattee reported that a new application re: Redding Road activity is expected.

Suggested discussion topics for the State of Conservation Initiatives in New England should be forwarded to N. Ketcham.

A Public Hearing on proposed amendments to the State Statute re: vegetative buffers around wetlands is scheduled for 2/23/09.

J. Ross and D. Pattee attended a meeting on 2/27/09 at the Yale School of Forestry re: future of forests in CT.

J. Ross reported that deer density is being analyzed regionally.~ Redding Deer Wardens met with N. Ketcham and D. Pattee and will be on an upcoming Conservation agenda.

On the motion of V. DeMasi and the second of J. Ross, the Commission voted unanimously to adjourn the meeting at 9:15 p.m.
