SPECIAL MEETING MINUTES

Tuesday, December 16, 2008
7:00 p.m. – Community Center, 37 Lonetown Road

Present: David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Joseph Beres; Victor DeMasi; Wallace Perlman.

The Chairman called the meeting to order at 7:05 p.m.

I.      PUBLIC HEARING TO CONTINUE
Application #08-25, Reeda B. Harsche (owner), Three Levels Corporation (agent), 626 Redding Road.  Received 8/5/08.  Public Hearing on an application for “Riverbend”, an affordable housing project on 14.19 acres pursuant to C.G.S. Section 8-30g. for the approval of a License for the construction of ten (10) units including the location of sealed pipes serving a subsurface waste disposal structure and related earth disturbing activities associated therewith upslope from the Saugatuck River and within 500’ of the high water line of a vernal pool line of a vernal pool as regulated pursuant to Section 2.23c of the Regulations.  Project activity involves ten (10) proposed dwellings, (13 housing units.)  Public Hearing opened 11/18/08.  Continued 12/2/08.

Mr. Harsche was present along with Atty. Neil Marcus and Russ Slayback, Leggette, Brashears and Graham.  Peter Olson, Conservation Commission Counsel was present in addition to Jim MacBroom, Commission Consultant.  

D. Pattee noted receipt of the following new letters into the record:

-letter dated 12/8/08 from G. Connolly
-report dated 12/11/08 from J. MacBroom
-letter and photographs dated 12/14/08 from J. Cullman
-letter dated 12/16/08 from Christopher Kimball
-Stormwater Management Plan and map dated 12/5/08

Dr. Piotr Parasiewicz was also in attendance.

V. DeMasi  reported that he listed to the 11/18/08 meeting tapes.

J. MacBroom reviewed his report and responded to questions from the Commission and the applicant.  P. Olson confirmed that this report was emailed

to Atty. Marcus on 12/10/08 and again on 12/15/08.   Questions regarding sediment and erosion controls were addressed in detail.

A 25-day extension was requested and granted by the applicant.  

D. Pattee confirmed that Dr. Parasiewicz is present as a consultant.  Dr. Parasiewicz reviewed his credentials and his report.  He conclusion noted his proposal of a conservation easement in this area rather than a proposed development.  Atty. Marcus addressed his questions to Dr. Parasiewicz.

Joan Ensor noted her concerns regarding the scope of the proposed development.  G. Connolly spoke regarding the liability and reliability of the project.  C. Couch expressed his concerns re: environmental impact and noted the history as it pertains to the land.

The Public Hearing will continue at the 1/6/09 meeting.

II.     APPROVAL OF MINUTES     -Minutes of 12/2/08

On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to approve the 12/2/08 Minutes as amended:  Page 1, second to last paragraph, second sentence, change to “ J. Beres stated that he has listened to the 11/18/08 meeting tapes.”; Page 2, first paragraph, fifth line, change “Coleman” to “Cullman”; Page 2, last paragraph, first line, change “Coleman” to “Cullman”.

III.    REGULATORY

Matthew Palmisano re: violations at 113 Cross Highway.  Discussion 9/2/09.

D. Pattee reviewed the report from B. Flanagan re: status of fence installation.

On the motion of J. Ross and the second of W. Perlman, the Commission voted unanimously to vote onto the agenda, 336 Newtown Turnpike re: Sediment and erosion controls.

Mr. Lambrech, property owner at 336 Newtown Turnpike, was present in addition to Craig Leneham, of South Ridge Properties and another contractor.  Mr. and Mrs. Corning, 340 Newtown Turnpike were also in attendance.

D. Pattee requested stabilization of the embankment by 12/19/08.  Mr. Pattee stated that all forms of sediment and erosion control be investigated other than silt fence.  Nancy Corning reported on the ongoing deposition of material into the
pond from weather events. Restoration of the neighboring pond will be required and discussed at the next meeting.

IV.     CHAIRMAN’S REPORT

D. Pattee reported on his meeting with M. Guitar and D. Taylor re: Garavel Scenic Easement violation.  

A note was received from J. Brooks re: two-lot subdivision on Black Rock Turnpike.  State DOT is requesting drainage across the property into the wetlands.  D. Pattee will forward this information to the neighboring property owner and ask for additional information from M. Lillis, CCA and S. Dennis, Bureau of Engineering and Highway Operations, DOT.

Zoning referral re: 241 Ethan Allen Highway was received.  

J. Ross stated that permission was not granted to allow hunters to cross Land Trust properties to get to Conservation properties.

The use of rifles by hunters on property less than 10 acres was discussed.


On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 9:55 p.m.
