MINUTES

Tuesday, January 16, 2007

8:00 p.m. - Old Town House

Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Joseph Beres; Wallace Perlman.

Absent: Victor DeMasi

The Chairman called the meeting to order at 8:00 p.m.

I.  APPROVAL OF MINUTES -Meeting of 1/2/07



On the motion of F. Schroeder and the second of W. Perlman, the Commission voted unanimously to approve the 1/2/07 Meeting Minutes as submitted.



II  REGULATORY



Application #06-38, Barrett Cram, Executor (owner), Steven D. Trinkaus (agent), 146 Cross Highway.  Received 10/17/06.  Discussion and possible vote on an application for wetland activities associated with a six-lot subdivision.  Site Walk 10/29/06.   Discussion 11/7/06; 11/21/06; 12/5/06; 12/19/06.  Received letter for a 65-day extension.  Discussion 1/2/07.

Barrett Cram was present along with Nancy Burton, intervenor.   

D. Pattee reviewed the response letter from Tom Ryder, Land Tech Consultants.  N. Burton submitted information solicited from two engineering firms.  D. Pattee clarified that Ms. Burton's "experts" did not inspect the site.

On the motion of J. Ross and the second of J. Beres, the Commission voted unanimously to approve Application #06-38 with a special condition requiring filter fabric to be placed at the interfaces of the stone blanket across the wetland and the stone subsurface at the same place as outlined in the Land Tech memo of 1/11/07.

Application #07-01, Derek R. Moots (owner), Joe Gorbecki (agent), 38 Goodsell Hill Road.  To receive and discuss an application for installation of an earth swale dividing #34 and #38 Goodsell Hill Road.

Mr. Gorbecki was present along with neighboring and abutting property owners including Mr. and Mrs. Williams and Mr. and Mrs. Harrick.  Mr. Gorbecki reviewed the application.  Mr. Williams reviewed the impact of increased water flow to his property.

D. Pattee clarified that an issue becomes a wetlands concern when wetlands are affected.  He questioned whether this was in fact more of a drainage issue and therefore a Zoning issue. 

A site walk was scheduled for Sun., 1/21/07 at 8:30 a.m.



III.  REFERRAL



Referral from Planning to the Conservation Commission for review of proposed open space set-aside.  Planning Application #512, "Lillian Estates", Frank Marini.  Proposed subdivision of 17.76 acres into three lots.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to send a positive response to the Planning Commission recommending approval of the proposed open space set-aside.



IV.   CHAIRMAN'S REPORT



D. Pattee noted receipt of a proposed amendment to the Zoning Regulations for a special development district for active adult residential village.  The Zoning Public Hearing is on 3/14/07.

Copies of the new Habitat were distributed.

D. Pattee has been notified of emails from G. Scholl.   

An appeal has been filed for Riverbend.

The Conservation Commission meetings will begin meeting at 7:30 p.m. starting February 6, 2007.

The upcoming auction of the Mangini property was discussed.  A lien has to be satisfied as part of the conditions.

On the motion of J. Ross and the second of W. Perlman, the Commission voted unanimously to adjourn the meeting at 9:25 p.m.
