MINUTES
 
Tuesday, June 5, 2007
Old Town House - 7:30 p.m.
 
Present: David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Joseph Beres; Victor DeMasi, seated at 7:38 p.m.; Wallace Perlman.
 
The Chairman called the meeting to order at 7:30 p.m.
 
I. APPROVAL OF MINUTES    -Meeting of 5/15/07
                                                            -Site Inspection of 5/23/07 - W. Frank and D. Lii
                                                                                                40 Lonetown Rd.
 
On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve the 5/15/07 Meeting Minutes.
 
On the motion of W. Perlman and the second of D. Pattee, the Commission voted unanimously to approve the Frank/Lii Site Walk Minutes.
 
II.   REGULATORY
 
Application #07-04, Noice Properties, LLC (owners), Kevin F. Morin (agent), 90 Black Rock Turnpike.  Received 2/20/07.  Discussion and possible vote on an application to re-set existing stone wall, install footing drain and earthmoving associated with a proposed resubdivision of Lot B-1 into two buildable lots.  Site Walk 3/4/07.  Discussion 3/6/07.  Public Hearing opened 4/17/07.  Public Hearing closed 5/1/07.  Discussion 5/15/07.
 
M. Lillis was present for the applicant.
 
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve Application #07-04 with the following conditions: 1) the stone wall which defines the eastern boundary of the above property shall remain undisturbed in its entirety.  Further the stone wall which runs east to west located in the northern lot shall remain undisturbed from its eastern extremity to a point defined on the CCA map sheet 3 by the regulated area (approximately ninety feet of undisturbed stone wall.)  This approval condition will maintain the existing water seepage noted at the confluence of the above walls in its present state;
 
 2) The level spreader on the southern lot shall be located in the extreme northeast corner of the allowable building area as pictured on the CCA map sheet 3 (topo line 508).  Further, the land to the east of this level spreader shall remain undisturbed so that the flow to the wetlands from this level spreader does not encounter new materials that may be carried to the wetlands.  This will direct the non septic footing drain flow over the longest possible path interrupted by the stone wall to the wetlands.  That should allow ground re-absorption consistent with the construction plan.
 
Application #07-01, Derek R. Moots (owner), Joe Gorbecki (agent), 38 Goodsell Hill Road.  Received 1/16/07.  Discussion and possible vote on an application for installation of an earth swale dividing #34 and #38 Goodsell Hill Road.  Site Walk 1/21/07.  Discussion 2/6/07; 2/20/07; 3/6/07; 3/20/07.  Received letter of 65-day extension.  Discussion 4/17/07; 5/1/07; 5/15/07.
 
M. Lillis and J. Gorbecki were present for the applicant.  Mr. Lillis displayed and reviewed a plan addressing drainage.   Mr. Gorbecki reviewed the construction scheduled as planned.
 
On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve Application #07-01 with the condition that the leaders, gutters and pipes to the infiltrator and infiltrator system be installed by 7/4/07.
 
Application #07-09, Walter Frank and Deborah Lii (owners), Peak Engineers LLC (agent), 40 Lonetown Road.  Received 5/15/07.  Discussion and possible vote on an application for pool construction and barn relocation.  Site Walk 5/23/07.
 
T. Quinn from Peak Engineers was present for the applicant.  Site walk findings were reviewed.
 
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve Application #07-09.
 
Application #07-10, Ercole and Elena Spinelli, 153 Sunset Hill Road.  To receive and discuss an application to build a shed with ¾" crushed stone within the regulated area.
 
Mr. Spinelli was present.  The proposal was reviewed and the Commission concurred that a license is not required.  The application fee will be refunded.
 
Application #07-11, Cameron and Carol Burr, 19 Goodsell Hill Road.  To receive and discuss an application to construct portion of single-family dwelling, well, roof and footing drain outlets within 100 ft. of a pond.
 
M. Mazzucco was present along with Mrs. Burr.  Drawings were displayed and the proposal was reviewed. 
 
A site walk was scheduled for Friday, 6/8/07 at 5:30 p.m. 
 
Application #07-12, David and Paige Petrie, 14 Great Pasture Road.  To receive and discuss an application to tear down old garage and shed and build new garage within the regulated area.
 
D. Petrie was present.  The proposal was reviewed and a site walk was scheduled for Friday, 6/8/07 at 6:00 p.m.
 
III.CHAIRMAN'S REPORT
 
Commissioners will review draft letter and report back to D. Pattee re: Zoning Commission consideration of proposed zone change.
 
DEP visited parks.  Signage is required on all parks.
 
No action was taken on HB1084 however; Public Act 07-102 was signed in law on 6/4/07. 
 
V. DeMasi will conduct the annual butterfly count on 6/30/07.
 
 
On the motion of V. DeMasi and the second of J. Ross, the Commission voted unanimously to adjourn the meeting at 8:42 p.m.
