MINUTES
 
Tuesday, April 17, 2007
7:30 p.m. - Old Town House
 
Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Joseph Beres; Victor DeMasi; Wallace Perlman.
 
Absent:   Frederick Schroeder
 
The Chairman called the meeting to order at 7:30 p.m.
 
I.  PUBLIC HEARING TO OPEN         
 
Application #07-04, Noice Properties, LLC (owners), Kevin F. Morin (agent), 90 Black Rock Turnpike.  Received 2/20/07.  Public Hearing on an application to re-set existing stone wall, install footing drain and earthmoving associated with a proposed resubdivision of Lot B-1 into two buildable lots.  Site Walk 3/4/07.  Discussion 3/6/07.
 
Mike Lillis from CCA was present for the applicant along with Attorney Neil Marcus.  Several abutters and intervenors,  William and Kay Oppenheimer, were also in attendance.
 
After a brief introduction by N. Marcus, M. Lillis presented the proposal accompanied by drawings.  He submitted letters and receipts from Aquarion and adjoining land owners. 
 
W. Oppenheimer read a letter noting his concerns including the delineation of wetland soils.  He submitted photographs of the woodchips currently dumped on the property.
 
S. Krivit, 86 Black Rock Turnpike, spoke in support of the Oppenheimer's.  Bob Heller, 91 Black Rock Turnpike, asked if a change in the stone wall is proposed.  D. Pattee stated that any comments regarding wetlands are the purview of this Commission and stone wall questions should be addressed to the Planning Commission during their review of this application.  J. Deacon, 87 Black Rock Turnpike, spoke in support of the project. 
 
Atty. Marcus addressed issues raised in W. Oppenheimer's letter.
 
S. Churchill, a principle of Noice Properties, stated that the woodchips were placed when the land was cleared.
 
J. Deacon questioned if this application was previously approved as a subdivision.  A history of the previous application was briefly reviewed by M. Lillis and clarified by K. Oppenheimer.
 
D. Pattee read a letter from James Lang, 98A Black Rock Turnpike.
 
On the motion of V. DeMasi and the second of W. Perlman, the Commission voted unanimously to continue the Public Hearing to the 5/1/07 meeting.
 
II. APPROVAL OF MINUTES   -Meeting of 3/20/07
 
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 3/20/07 Minutes.
 
III. REGULATORY
 
Application #07-01, Derek R. Moots (owner), Joe Gorbecki (agent), 38 Goodsell Hill Road.  Received 1/16/07.  Discussion and possible vote on an application for installation of an earth swale dividing #34 and #38 Goodsell Hill Road.  Site Walk 1/21/07. Discussion 2/6/07; 2/20/07; 3/6/07; 3/20/07.  Received letter of 65-day extension.
 
Joe Gorbecki was present for the applicant. Neighbors Eddie Williams and Mr. and Mrs. Harrick were also in attendance. 
 
D. Pattee noted receipt of a letter dated 2/12/07 with an attachment dated 11/289/06 from T. Gormley.  A letter dated 3/22/07 from D. Hartline was read by D. Pattee along with a letter dated 4/15/07 from Mrs. Harrick.
 
J. Gorbecki responded to Mrs. Harrick's letter and stated that K. Langer could be contacted regarding the tree work.  He submitted a preliminary drainage improvement plan which was displayed and reviewed. 
 
E. Williams reiterated his concerns and submitted photographs regarding the recent water event and effects on his driveway. 
 
The proposed construction sequence was reviewed in relation to gutter placement.  D. Pattee requested that Mr. Gorbecki return for the next meeting with the complete information from an engineer for review.


 
Application #07-05, Seth and Laura Sanford, 8 George Hull Hill Road.  To receive and discuss an application for installation of a 10' x 16' shed within the regulated area.
 
Seth Sanford was present.  After a brief review, the Commission concurred that no wetlands license is required and the application fee will be refunded.
 
Application #07-06, William Nelson (owner), Aaron Nachbar (agent), 23 Chestnut Woods Road.  To receive and discuss an application to replace domestic water supply well.
 
Aaron Nachbar was present for the applicant.  The proposal was reviewed and a site walk was scheduled for Fri., 4/20/07 at 5:30 p.m.  D. Pattee requested that the proposed well location be staked.
 
IV.  CHAIRMAN'S REPORT
 
Referral from Bethel for zone change on Trowbridge Drive-Terra Haute.  Public Hearing 4/24/07.
 
V. DeMasi will draft a letter noting concerns of this Commission. 
 
Referral from Zoning re: zone change, Reeda Harsche.  The Public Hearing is scheduled for 5/23/07.
 
A Sprint/Nextel cell tower is proposed at the Fire Station on Black Rock Turnpike.
 
A list of town-owned open space was distributed.
 
F. Schroeder's letter to Aquarion re: proposed fees was distributed.
 
D. Pattee noted receipt of an article and comment from Mr. and Mrs. Oppenheimer re: amphibians.
 
J. Ross noted two walks to take place on Earth Day, 4/21/07.  W. Perlman and W. Hill will assist in dismantling and rebuilding bridge on Thurs., 4/19/07 at 9:00 am at the intersection of John Read Road and Little River.
 
On the motion of V. DeMasi and the second of W. Hill, the Commission voted unanimously to adjourn the meeting at 10:25 p.m.
