MINUTES
Tuesday, August 21, 2007
7:30 p.m. - Old Town House
 
Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Victor DeMasi; Wallace Perlman.
 
Absent: Joseph Beres
 
The Chairman called the meeting to order at 7:35 p.m.
 
On the motion of F. Schroeder and the second of W. Perlman, the Commission voted unanimously for R. Dean of the Redding Planning Commission to present interpretation of regulations first on the agenda.
 
Mr. Dean was present at the request of the Conservation Commission to discuss the Planning Commission's regulation that concerns multiple driveways going to rear lots. 
 
I. APPROVAL OF MINUTES   -Meeting of 8/7/07
                                    Site inspections of 8/14/07        -R. Paltauf, 95 Great Oak Lane
                                                                                    -Mr. R. Stewart, 8 Limekiln Road
 
On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 8/7/07 Meeting Minutes.
 
On the motion of W. Perlman and the second of W. Hill, the Commission voted to approve the 8/14/07 Site Walk Minutes.  F. Schroeder abstained.
 
II.REGULATORY
 
Application #07-18, Frank Marini, 417 Rock House Road.  Received 8/7/07.  Discussion and possible vote on an application for regulated activities associated with a proposed two-lot subdivision.  Report from Planning Commission to be received.
 
Mr. Marini was present along with the Atty. P. Gelderman and R. Ochman.  D. Pattee noted receipt of Notices of Intervention from P. McIlaney, L. Zielinski and W. and K. Oppenheimer.  A petition to hold a Public Hearing was also submitted with 33 signatures. 
Atty. Gelderman displayed and reviewed the plans.
 
On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to hold a Public Hearing on 9/18/07, 7:30 p.m.  A petition was received with more than 25 signatures.
 
III. ENFORCEMENT
 
Notice of Violation issued to Mr. Ray Paltauf, 95 Great Oak Lane, placing of material within the regulated area.  Site Walk 8/14/07.
 
Mr. Paltauf was unable to attend this meeting; however, he dropped off a drawing and plans on attending the next meeting.  Mr. Paltauf will be requested to fill out an application for remediation purposes to be reviewed at the next meeting.
 
Notice of Violation issued to Mr. George DiScala, 78 Dorothy Road, digging and depositing material in a regulated area.
 
Mr. DiScala was present.  He distributed and reviewed his application.  D. Pattee recommended that a soil scientist be obtained to determine wetland boundaries.  Per Mr. DiScala, silt fence was installed on Fri., 8/17/07.  Mr. DiScala will provide status reports to C. Keil and discussion will continue pending receipt soil scientist report.
 
IV. COMPLAINT
 
Email received from Bill and Kay Oppenheimer re: field maintenance at Joel Barlow High School.
 
Representatives from Joel Barlow were present including Dr. Fossbender.  Details were provided re: one-time application of herbicide/pesticide containing 24D.  As noted in the IPM plan, the least toxic application should be applied first.  The schedule of turf management was reviewed in detail.
 
D. Pattee reviewed current and proposed legislature re: use of pesticides on school fields.  It is preferred that products containing 24D are not used.  A less toxic alternative should be explored for use and when chosen, the material safety data sheet should be forwarded to the Commission. 
 
A procedure for handling future inquiries of this type is being considered.
  
V.CHAIRMAN'S REPORT
 
Russell Stewart, 8 Limekiln Road.  Discussion of status of pond conditions as a result of sand deposition from roads.  Discussion 8/7/07.  Site Walk 8/1407. 
 
Mr. Stewart was present.  D. Pattee reviewed the site walk findings.  Per Mr. Stewart, B. Sanford and N. Ketcham have visited the site.  Mr. Stewart is awaiting further contact from Mr. Sanford.  Short-term and long-term options were discussed.  D. Pattee will contact Mr. Sanford directly re: status of catch basin cleanings.
 
Dennis Tobin, WEO/ZEO for GLDC will be given permission to sign off on head sheets pertaining to upcoming GLDC applications on behalf of the Conservation Commission.
 
League of Women Voters is meeting on 9/27/07 at 4:00 p.m.  R. Dean of the Planning Commission will be presenting information on the Town Plan of Conservation & Development.
 
Re:  Church Hill Road/Poverty Hollow Road intersection.  A draft landscaping plan has been submitted.
 
F. Schroeder reported that the trail dedication for John Mitchell will be held on Sat., 9/29/07 at 11:00 a.m. at the south side of Lonetown Marsh.
 
Items located in Factory Pond will be removed on Fri., 8/24/07 at 2:00 p.m.  Commissioners are invited to participate.
 
The Zoning Commission held a special meeting on 8/20/07 re: draft resolution denying the Riverbend application.
 
 
On the motion of V. DeMasi and the second of W. Hill, the Commission voted unanimously to adjourn the meeting at 11:02 p.m.
