MINUTES

Tuesday, November 7, 2006

7:30 p.m. - Old Town House

Present:  David Pattee, Chairman; Jeremiah Ross; William Hill; Frederick Schroeder; Joseph Beres; Victor DeMasi; Wallace Perlman.

The Chairman called the meeting to order at 7:30 p.m.

I.  PUBLIC HEARING TO CONTINUE



Application #06-24, Reeda B. Harsche (owner), Three Levels Corporation (agent), 626 Redding Road.  Received 7/18/06.  Discussion on an application for "Riverbend", an Affordable Housing Project on 14.19 acres for the proposed location of a subsurface waste disposal system and earth disturbing activities associated with ten (10) proposed dwellings, three (3) of which will have a one-bedroom accessory apartment.  Site Walk 7/25/06.  Public Hearing opened 9/19/06.  Continued 10/3/06; 10/17/06.

Atty. Neil Marcus was present along with Mr. Harsche.  D. Pattee noted receipt of a letter dated 1023/06 granting an extension to the Public Hearing.  Mr. Pattee reiterated that this hearing is for responses to previous information, no new information . The following new letters have been received:

Atty. Marcus submitted legal comments re: Bethel case concerning 8-30g.  Additional copies will be submitted to the Commissioners. 

J. Hixon read a quote from a tape from a Public Hearing on the previous application regarding the safety of Gallows Hill Road.  He requested that the tape be submitted as part of the public record on this application.  D. Pattee accepted submission of the tape with the understanding that it would be considered during deliberation however it is not within the purview of this Commission.

Atty. Marcus objected to acceptance of the quote as it is out of context.  He stated that he would agree to accept a transcript of the full tape.

On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to close the Public Hearing.

Deliberations will begin at the meeting of 11/21/06.



II.  APPROVAL OF MINUTES        -Meeting of 10/17/06

ON the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 10/17/06 Meeting Minutes as amended:  Page 3, fourth item under "Chairman's Report", change to "D. Pattee reported that Gov. Rell…".

On the motion of W. Perlman and the second of F. Schroeder, the Commission voted to approve the 10/29/06 Site Walk Minutes.  J. Ross abstained.



II.  REGULATORY



Application #06-38, Barrett Cram, Executor (owner), Steven D. Trinkaus (agent), 146 Cross Highway.  Received 10/17/06.  Discussion and possible vote on an application for wetland activities associated with a proposed six-lot subdivision.  Site Walk 10/29/06.

S. Trinkaus and B. Cram were present along with a neighbor and intervenor Nancy Burton.   

S. Trinkaus displayed a map and reviewed the proposed regulated activities.   

D. Pattee noted receipt of a Notice of Intervention from Nancy Burton and stated that copies of all submitted materials should be forwarded to Ms. Burton.

A letter and petition to hold a Public Hearing was submitted.  D. Pattee noted that the statutory requirement to hold a Public Hearing if a petition is submitted within 14 days was not met.  The petition signers are urged to attend the next meeting when a decision will be make re: Public Hearing.

Application #06-39, Peter Rowan (owner), Frank Fowler(agent), 26 Long Ridge Road.  Received 10/17/06.  Discussion and possible vote on an application for a septic system installation to replace a failing system within the regulated area.  Site Walk 10/29/06.

On the motion of W. Perlman and the second of W. Hill, the Commission voted unanimously to approve Application #06-39.

Application #06-40, Bridle Road Association (D. Heller), Groundworks, B. Cram (agent), Spur Rd.and Bridle Rd.  To receive and discuss an application to excavate for installation of dry hydrant at edge of pond.

B. Cram was present.  The proposal was reviewed and a site walk was scheduled for Sun., 11/19/06 at 8:30 a.m.

Application #06-41, David and Bonnie Kasiarz, 9 John Todd Way.  To receive and discuss an application for construction of a detached garage within the regulated area.

Gary Mead was present for the applicant.  He displayed a map and reviewed the proposal.  A site walk was scheduled for Sun., 11/19/06 at 9:00 a.m.

Application #06-42, Robert and Susan Wilhelmy, 269 Newtown Turnpike.  To receive and discuss an application for construction of a pool house/changing room within the regulated area.

Mr. Wilhelmy was present. He reviewed the proposal accompanied by a drawing.  A site walk was scheduled for Sun., 11/19/06 at 8:45 a.m.



IV.  CHAIRMAN'S REPORT



N. Ketcham forwarded a memo re: Wildlife Habitat Incentive Program sponsored by the NRCS and is looking for a volunteer to participate.

D. Pattee noted a new statute re: encroachment of open space lands.

Information re: the Governor's Executive Ordinance Championing Responsible Growth.

Aquarion is now requiring online notification of applications in the watershed.

D. Pattee attended Training Session III sponsored by the DEP.

F. Schroeder reported on a recent article in the Danbury News-Times re: open space.




On the motion of V. DeMasi and the second of J. Ross, the Commission voted unanimously to adjourn the meeting at 9:07 p.m.
