MINUTES

Tuesday, November 21, 2006

8:00 p.m. - Old Town House

Present:  David Pattee, Chairman; Jeremiah Ross; Frederick Schroeder; Victor DeMasi; Wallace Perlman.

Absent: William Hill; Joseph Beres

The Chairman called the meeting to order at 8:00 p.m.

I.  APPROVAL OF MINUTES -Meeting of 11/7/06

On the motion of W. Perlman and the second of J. Ross, the Commission voted unanimously to approve the 11/7/06 Meeting Minutes as amended:  Page 3, last line, add "will be furnished to the Commission"; Page 4, first line, change to "Aquarion is now requiring online notification of  applications in the watershed to the DEP."

On the motion of J. Ross and the second of W. Perlman, the Commission voted unanimously to approve the 11/19/06 Site Walk Minutes as amended.



II.  REGULATORY



Application #06-24, Reeda B. Harsche (owner), Three Levels Corporation (agent), 626 Redding Road.  Received 7/18/06.  Discussion on an application for "Riverbend", an Affordable Housing Project on 14.19 acres for the proposed location of a subsurface waste disposal system and earth disturbing activities associated with ten (10) proposed dwellings, three (3) of which will have a one-bedroom apartment.  Site Walk 7/25/06.  Public Hearing opened 9/19/06.  Continued 10/3/06; 10/17/06.  Public Hearing Closed 11/7/06.

Commissioners reviewed the application and noted their concerns and issues.  Issues discussed will be drafted for further review and continued deliberation at the next meeting.

Application #06-38, Barrett Cram, Executor (owner), Steven D. Trinkaus (agent), 146 Cross Highway.  Received 10/17/06.  Discussion and possible vote on an application for wetland activities associated with a proposed six lot subdivision.  Site Walk 10/29/06.  Discussion 11/7/06.

B. Cram and S. Trinkaus were present along with Nancy Burton, intervenor, and several nearby residents.  Ms. Burton submitted new information and reiterated her request to hold a public hearing. 

Dennis Gibbons noted his concern regarding the chemical treatment of lawns and the steep incline of two proposed rear houses re: runoff.  S. Gormley stated his desire to maintain the rural character of Redding.

S. Trinkaus reviewed the proposed driveway cut and responded to issues and concerns brought up by Ms. Burton and other residents.  The proposed regulated activities were reviewed in detail.  The possibility of a conservation easement around the pond was discussed.

Commissioners will review the information presented at this meeting and a decision regarding a public hearing will be made at the next meeting.

Application #06-40, Bridle Road Association (D. Heller), Groundworks, B. Cram(agent), Spur Road and Bridle Road.  Discussion and possible vote on an application to excavate for installation of dry hydrant at edge of pond.  Site Walk 11/19/06.

B. Cram was present.  Site walk findings were reviewed.  Mr. Cram will investigate the use of obtaining a turbidity curtain as recommended by D. Pattee.  Discussion will continue.

Application #06-41, David and Bonnie Kasiarz, 9 John Todd Way.  Received 11/7/06.  Discussion and possible vote on an application for construction of a detached garage within the regulated area.  Site Walk 11/19/06.

Gary Mead was present for the applicant.   

On the motion of J. Ross and the second of W. Perlman, the Commission voted unanimously to approve Application #06-41 with the condition that the drawing be amended to shows the roof drain exiting at the northeast corner of the proposed garage.

Application #06-42, Robert and Susan Wilhelmy, 269 Newtown Turnpike.  Received 11/7/06.  Discussion and possible vote on an application for construction of a pool house/changing room within the regulated area.  Site Walk 11/19/06.

Mr. Wilhelmy was present.  A larger scale drawing was submitted and silt fence locations were added.

On the motion of W. Perlman and the second of F. Schroeder, the Commission voted unanimously to approve Application #06-42.

Application #06-43, Paul and Dolores Gillap (owners), Kelly Sullivan (agent), 3 Little Boston Lane.  To receive and discuss an application for installation of an inground concrete swimming pool approximately 72 feet from the wetlands.

Kelly Sullivan was present for the applicant. Alternatives to the proposed filter presented will be discussed at the next meeting.  Concerns were noted regarding the use of a re-useable cartridge filter vs. disposable cartridge filter. 

A site walk was scheduled for Sun., 11/16/06 at 8:30 a.m.

Application #06-44, Antonia Neves and Maria Lopes, 28 Blueberry Hill Road.  To receive and discuss an application for tree and brush removal from bank and landscaping within the regulated area.

Mr. Neves was present.  The proposal was briefly reviewed.  A site walk was scheduled for Sun., 11/26/06 at 8:45 a.m.

ADDENDUM
Discussion re: gift of open space easement, Whortleberry Road, Atty. Ward Mazzucco.

W. Mazzucco was present.  He reviewed the Conservation Restriction and Easement.

On the motion of W. Perlman and the second of V. DeMasi, the Commission voted unanimously to accept the Conservation Restriction and Easement located at 60 Whortleberry Road, Parcel A.



III.  CHAIRMAN'S REPORT



D. Pattee will be attending a stormwater management session on 12/4/06 in Westchester County.
